Information set: written as the pre-market 2026-10-08 read. Last completed session is 2026-10-07; the gating number below is recomputed from my own verified IWM price pipeline (Alpaca), not read from today's log.
data-infra/regime/current.json (ASSAY, status: ok, as_of: 2026-09-22) — 11 sessions / 16 calendar days stale — flagged STALE, read as reported without authority: spy_day: flat · spy_open_to_close_pct: −0.08 · spy_vs_sma50: above 50d · spy_drawdown_bucket: <2% (spy_drawdown_pct −0.58) · vix_regime: LOW (<18) (vix 14.21). The file contains nothing from 09-23 → 10-07; its VIX (14.21) against the briefing's live 15.96 is a +1.75 gap, but both remain in LOW (<18), so the label survives the lag even as the file carries no authority today. I flag it; I do not lean on it.
Charter consistency — consistent, with two indicators moving, and the status stated first. The desk CLAUDE.md ## Regime Charter reads Status: DRAFT — not ratified; this is a self-check against unratified text. spy_vs_sma50 = above 50d and spy_drawdown_bucket = <2% are the live state the draft describes (with the honest asymmetry it records — above-50d is the inferential bucket, N=42, and it is the one I sit in). vix_regime = LOW is the bucket in which my gate is silent by design; a step up the ladder is what the draft says I want, not a threat. Two things are genuinely moving. (1) My own exceedance rate — as last measured (2026-10-07, not re-run this session), threshold fixed at 4.970946%: dev (2020–2023) 15.010% (151/1,006 raw windows); trailing-60 0/60 = 0.00% (0.00×); trailing-250 11/250 = 4.400% (0.29×); the offset-sensitive non-overlap restatement reads dev 12.38% (25/202), trailing-60 0/12, trailing-250 1/50 = 2.00% — a tenth consecutive short reading on the raw form. (2) The shared VIX tag's direction — 15.96 is still firmly under the draft charter's own MID (≥18) shift condition; the persistence rule (5 consecutive sessions in the new state) has not begun. Today's plan — stand flat, change nothing — is consistent with the draft charter. The exceedance state satisfies persistence many times over, so it belongs in the next monthly Desk Review as a proposal, never a unilateral move. Watch and report only: no gate, no sizing, no posture, no script.
state/position_ledger.json → {"open_position": null}.State-machine leg, stated plainly first because it is the leg the desk is built to report. agents/slack/state/position_ledger.json reads {"open_position": null}. Two of my three branches are dead on arrival: nothing is held, so no hold-silently marker today, and nothing to close, so no close-and-log due — no day-1..5 counter is running because no cycle was ever opened. Today is day 0 of a cycle that has not started: not an open day, not a hold day, not a close day — a no-signal day, and today's action is to stay flat and log no_trade:no_signal. The one branch that can log a real trade is an entry at today's open, gated by the run settled at the last completed close — the run ending 10-07's close, measured this session on my own pipeline at −0.0971% (277.690 / 277.960 − 1) against ±4.970946%. That is 4.87pp short of the down-flag and 5.07pp short of the up-flag. Today's open is closed mechanically and my call is exact rather than probabilistic: p_trade 0.0, direction none, conviction high.
Where the run sits — the up-leg rolled straight back through the 10-07 down day. The recent settles ran −2.81% (09-29) → −1.43% (09-30) → −0.92% (10-01) → −0.18% (10-02) → +1.19% (10-05) → +0.80% (10-06) → −0.10% (today's gate). The two positive readings of early October did not hold: IWM's −1.29% session on 10-07 pulled the window back to roughly flat. This is the same isolated-brush-and-recede shape the desk has logged all quarter — a drift toward the band, then a roll away — not a graze. Closest Phase 3 reading remains the −3.2% brush logged on the 09-16 row (1.7pp short); deepest positive remains +3.92% on 08-06 (1.05pp). No cluster in either the −4.0%→−4.97% or the +4.0%→+4.97% band, in 68 logged sessions.
What would have to happen at today's close to matter at all. An entry at Friday 10-09's open needs the run ending today's close to cross. The window's base rolls up from 277.960 (09-30) to 279.050 (10-01), so a flat close at 277.690 reads −0.487%. Against the ±4.970946% flag: an up-flag needs a close ≥ 292.92 — a +5.49% session; a down-flag needs ≤ 265.18 — a −4.51% session. For scale, trailing-20 daily ATR is 3.67, about 1.32% of spot — so the up-flag asks ~4.2σ and the down-flag ~3.4σ in a single session. On a mixed, headline-sensitive tape with a 1:00 PM long-bond auction, an 8:30 AM claims print, and no IWM print of its own, my call: no flag settles at today's close either. And I give the mechanic, not just the level: the reading moves on window composition — a large session rolling off the back travels it 2–3pp on a sub-1% tape, and today the base rises 277.960 → 279.050, which pulls the reading down (~−0.4pp of drag on the up-leg), which is why a flat close reads −0.49% rather than higher.
The firm's GO rule — does it bind me today? Moot, and I say why rather than wave at it. SLACK's locked mechanism carries no event-day gate of its own (strategy_v2.md Rule 6: no stop, no target, no early exit — and no calendar override). The firm's deterministic Tier-1 rule is therefore the only thing that could stop an event-day entry, and on a day a flag settled on a Tier-1 print it would skip the entry. Today it is moot twice over: the firm reads GO, and my book is flat with the gate uncrossed, so there is no entry candidate for any rule to act on. My flatness is mechanical, not calendar-driven. The hold-spanning-event question stays live and I name it in advance: any flag settling at today's close would enter Friday and hold across the CPI (10-14) by construction, not by choice — there is no event-day override in the locked design, and I will not invent a discretionary skip (that is a strategy change and it is TEMPER's, not mine).
Setup present: no — mechanically excluded at today's open (4.87pp short), and not plausibly reachable at today's close. Sizing vs. event risk: nothing to size today, and no override exists to apply. With p_trade 0.0 there is no notional, no entry window and no exit to adjust. The locked parameters stand unchanged: 15% of equity as fixed notional (≈$3,750 on the $25K account), single position at a time, no stop-loss, no profit target, no early exit. Today's MEDIUM event risk has no purchase on the size and no role in the exit — the sizing is calibrated for exactly this class (the March 2020 COVID-week long, −19.66% of notional ≈ −3% of equity); event risk is a carry cost here, not a gate input.
Session-character fit: poor for intraday structure, irrelevant to me — and I say so instead of manufacturing a view. I have no intraday component: I check IWM once, at the open, and hold five sessions. A headline-sensitive tape, VIX pinned in LOW, no IWM pre-market print, and a mid-morning claims print plus a 1:00 PM auction are precisely the conditions that do not manufacture a 5-day ±4.97% extent. This is now 68 consecutive logged no-signal sessions through 10-07 (07-02 → 10-07 unique; the duplicate 08-07 row stays flagged for cleanup and is not counted), and today would make it 69 once logged. SPRT at n=0, W0/L0, LLR +0.000, both boundaries (±2.944) untouched — and by construction it cannot flag at n=0, which is exactly why the exceedance test exists beside it. I want the flag; I do not expect it.
Key levels and invalidation. The binding level is the ±4.970946% 5-day run threshold, full stop; every other level is context. Measured structural refs: ~$275–278 floor (10-01 low 275.510; 09-30 close 277.960 and 10-07 close 277.690) / ~$291–294 ceiling (trailing-20 intraday high 291.410; 60-day high 305.18). IWM gave back the early-October bounce on 10-07 (−1.29% to 277.690), back to the top of the late-September floor zone — so the down-leg is marginally the nearer route again, but the gate needs a 5-session extension, not one gap-down day. Invalidation for today: none applies — flat, no entry reachable at either the open or a plausible close, no scheduled exit, nothing held into the 8:30 claims print, the 1:00 PM auction, or the Waller remarks.
Rolling exceedance — the only live falsifier this stack has (read-only, as last measured 10-07). Threshold held at 4.970946%: dev (2020–2023) 15.010% (151/1,006 windows); trailing-60 0/60 = 0.00% (0.00×); trailing-250 11/250 = 4.400% (0.29×). The non-overlapping restatement (the 09-25 peer-review disposition) reads dev 12.38% (25/202), trailing-60 0/12, trailing-250 1/50 = 2.00%, and it is offset-sensitive (trailing-250 moves 4.40% → 6.00% on slice offset). So the direction survives both forms but the exact level is not yet stable; the 5.00% / 2.50% trigger thresholds remain provisional pending a block-bootstrap restatement, and the restatement is the standing October Desk Review item routed to TEMPER — not filed on the raw form, nothing changed unilaterally.
What I'm watching: (1) the run settling at today's close — the only number that matters, gating a possible 10-09 entry — bounded through the roll: base rises to 279.050, a flat close reads −0.487%, and a flag needs a +5.49% or −4.51% single-session close; my call: no flag. (2) The ~$291–294 ceiling / ~$275–278 floor — IWM gave back the bounce on 10-07 and sits at the top of the floor zone; a renewed push toward the ceiling would need a five-session extension, not one day. (3) Whether VIX's level holds below the draft charter's own MID (≥18) shift condition — five consecutive sessions in MID would begin the persistence clock, and that is the state my mechanism actually wants; today's 15.96 is still firmly LOW. (4) My own exceedance rate — the tenth straight short reading, and the non-overlap restatement plus the Mneme timestamp alignment are the two things in this stack's live history that can falsify a silent gate. (5) The event calendar — any flag this week holds across CPI (10-14), and I have named that exposure in advance rather than after the fact.
