Regime Watch

Read data-infra/regime/current.json (ASSAY); report only.

  • Read: status: ok, as_of: 2026-09-22 — i.e. stale by NINE sessions (it lags 09-23, 09-24, 09-25, 09-28, 09-29, 09-30, 10-01, 10-02 and today). Snapshot: spy_day flat, spy_open_to_close_pct −0.08% / spy_vs_sma50 above 50d / spy_drawdown_bucket <2% (spy_drawdown_pct −0.58%) / vix_regime LOW (<18), vix 14.21.
  • Level from the briefing, not the file: live ^VIX is 16.30 (prior close 15.31) — same LOW bucket, ~1.7 points under the LOW/MID boundary at 18. SPY prior close 769.65 is above its 20-day mean (SMA20 764.83); QQQ 749.49 above SMA20 727.77.
  • Charter indicators moving: none of the three shared tags is in a stressed state on the file — spy_vs_sma50 above 50d, spy_drawdown_bucket <2%, vix_regime LOW. But the file is nine sessions stale, so this is not a clean read. Applying the discipline this desk itself filed at the 2026-10-02 peer review (and the critiques that desk received): an unobserved regime state is not a benign one. I record "no confirmed trigger; persistence INDETERMINATE pending a dated refresh of 09-23 onward" — not "0 of 5."
  • Consistency with the desk's ## Regime Charter: the charter is DRAFT — not ratified, and I am held to it as drafted. The draft's claim is that this desk does not need the market to go up: ECHO trades contra the day's direction, SURGE with it, both intraday and direction-agnostic. Today is not a hard skip — both engines evaluate — and neither stack carries a directional bias, so the plan needs no rally. Consistent with the draft on substance; not scored as charter-compliant (not ratified).
  • Persistence rule: not armed on any confirmed basis. No confirmed 5-session stretch in a stressed tag state (the stale feed cannot arm or clear it), and neither stack is near the 10-consecutive-no-fire clause — ECHO is 7 no-fire sessions (last fired 09-23) → today would be the 8th; SURGE is 4 (last fired 09-28) → the 5th. No proposal, no posture change, watch only. I do not move a gate on regime evidence alone.

Shared Market Read

  • Event risk today: MEDIUM. No Tier-1 release. Next Tier-1 is FOMC Minutes, Wed 2026-10-07, 2:00 PM ET (an event window, not a firm-wide hard skip). Today's scheduled macro: ISM Services PMI, 10:00 AM ET (consensus 55.4 vs prior 55.7; MEDIUM — today's clearest scheduled volatility window), plus S&P Global Services/Composite PMI Final 9:45 AM ET (LOW). Market is open; the Scanner's firm-wide status is GO — no hard skip.
  • Session character expected: mixed and news-driven. The briefing: opening structure may be tentative before the 10:00 print, then price-discovery; momentum needs post-ISM follow-through plus rates confirmation, and "a fast move that fails to broaden or loses rates confirmation can set up a fade." Overnight index futures were only modestly lower (S&P −0.15%, Nasdaq-100 −0.23% ~07:03 ET) with no confirmed gap.
  • VIX regime: 16.30 — LOW (<18), the weakest cohort for both members (ECHO needs a completed high-participation program to have something to exhaust; SURGE's backtest PF is 1.36 in VIX < 20 vs 2.18 at 20–30). Neither stack has a VIX parameter — ECHO's hard skip is a first-half-hour |return| proxy (1.8%), SURGE has no VIX skip. LOW is background, not a gate input.
  • Key levels: SPY prior close 769.65 (prior range 767.16–772.65; SMA20 764.83 — above; ATR14 7.12). QQQ prior close 749.49 (prior range 747.63–754.51; SMA20 727.77 — above; ATR14 9.70). An open beyond ≈ ±0.5% (SPY ≈ 3.8 pts, QQQ ≈ 3.7 pts) would be a genuine gap; the IEX pre-market shows no confirmed liquid print (confirm at the open).
  • Macro backdrop: the market is balancing hopes the Fed holds this month after Friday's soft jobs report against persistently elevated long-end yields; the rates/Fed-policy repricing is the driver, and Wednesday's FOMC minutes keep that narrative in play all week.
  • Scanner candidate read (ECHO's dynamic universe): SPY is the sole Directional Catalyst candidate — broad-market macro via ISM Services PMI, intrinsic catalyst yes, but weak-to-moderate until the print (no confirmed gap). XLE — driver is crude, no EIA today (EIA is Wednesday), oil eased on European fuel-stock-release discussion but remains Middle East-sensitive. XBI — no confirmed FDA/PDUFA catalyst; not a candidate. So ECHO's fresh-catalyst universe is effectively SPY, and its engine will also evaluate its baseline SPY/XLE/XBI set.

ECHO — dynamic universe (SPY/XLE/XBI baseline), close-leg exhaustion fade at 15:30 ET

Possible, but low — a MEDIUM macro print could manufacture the program I fade, yet vol_ratio is the chronic binder and this is a LOW-VIX tape. p_trade 0.12, direction none, conviction low.

My mechanism needs a gate-confirmed directional program that ran all day and is substantially complete by 15:20, which I fade contra at 15:30. No hard skip applies today — is_hard_skip_day() skips {FOMC, CPI, NFP} and none is live; prior VIX close 15.31 < 30; no mega-cap earnings after prior close; XBI is not ≤ −5%. So the engine will evaluate.

Why not zero, and why not more. The ISM Services PMI at 10:00 ET lands after my 9:30–10:00 signal window — the morning signal forms before the print. That is genuinely two-sided for me: a post-10:00 repricing that holds to 15:20 with elevated volume is exactly the "fast move that fails to broaden" the briefing names as a fade — my setup. But the chronic binder is Gate 1, vol_ratio ≥ 1.2, and on LOW-VIX tapes (VIX 16.30, same as the whole recent stretch) it has been blocking wide: across the last seven sessions SPY/XLE/XBI printed vol_ratio 0.58–1.10, none near the floor. A morning that never establishes ≥ ±0.25% is the other likely denial. A single fresh-catalyst instrument (SPY) — not three — further lowers the odds of a qualifying slot. I forecast low, not zero: the catalyst is real and broad-market, and my mechanism is built to fade exactly this kind of session.

direction none — I fade the day's direction, which is unresolved pre-market (no confirmed gap; the ISM print sits after the signal window). No honest directional lean exists; hit-rate is skipped for none.

Sizing vs. event risk: standard applies if it fires — 0.75% per instrument, 2.0% session budget ($500) with proportional scaling, stop 1.5× ATR(14, 5-min), hard flat 15:58 ET. No adjustment for MEDIUM event risk: ISM is not a hard skip, and the mechanism's own gates (vol_ratio, exhaustion_score) are the filter. No gate logic modified.

Key levels (context, not triggers): SPY 769.65 / range 767.16–772.65 / SMA20 764.83 (above) / ATR14 7.12. XLE — no EIA today; crude's polarity is genuinely two-sided (eased on fuel-stock-release discussion, still Middle East-sensitive), so on any other day the fade direction would be unresolved. XBI — no confirmed catalyst, not a candidate; the first-half-hour ≤ −5% hard skip stands if it ever evaluates.

Invalidation: no trade if the morning signal is sub-±0.25% (likely on a tentative pre-ISM open) or vol_ratio stays sub-1.2 through 15:20. Most likely logged reason: no_qualifying_instruments (vol_ratio or morning_signal). No overnight exposure — 15:58 ET flat.

What I'm watching (specific, not filler):

  1. Does the 10:00 ISM print manufacture a one-way program that holds to 15:20 with vol_ratio ≥ 1.2 and exhaustion_score ≥ 0.80 — or does the tape again print a wide morning signal on sub-floor volume (the modal denial of the recent stretch)?
  2. The fade-vs-chase fork the briefing names — does the initial reaction hold (breadth + rates confirmation) or reverse as yields respond?
  3. XLE, if it grazes again. XLE bound vol_ratio on three consecutive eligible sessions (09-29 1.088, 10-01 1.070 vs 1.2). If it sits in the 1.08–1.20 band again, I log it as an observation only. Per the 2026-10-02 peer-review disposition (House Delta → House Echo): the 09-29 XLE counterexample is an UNVERIFIED observation, not evidence the 09-05 diagnostic's mechanism failed — it infers qualification from two displayed gates, not a rerun of the full locked evaluator. It will be treated as a candidate observation pending a clean rerun through the current date before TEMPER uses it. No gate touched.

SURGE — SPY/QQQ, VWAP pullback resumption (10:00–12:00 ET)

Unlikely — the ISM print lands exactly at my establishment moment, and a 10:00 macro catalyst is my known weak class on a LOW-VIX tape. p_trade 0.10, direction none, conviction low.

I need a clean three-phase structure inside 10:00–12:00: a first-hour establishment (|signal_return| ≥ 0.30%), a measured pullback to session VWAP on contracting volume, and a resumption confirmation candle with ADX ≥ 22 at the resumption bar. No event-day skip applies today — FOMC/CPI/NFP/PCE/QQQ-earnings are all clear — so the engine will evaluate SPY and QQQ.

Why low. The ISM Services PMI prints at 10:00 ET — the exact moment my first-hour signal is measured and my establishment window opens. A macro print at the open of the window is the catalyst-gap class my 07-24 learning has at 0/2: the first hour becomes price-discovery, not a clean trend establishment, and the three-phase structure is structurally invalid there. VIX 16.30 LOW is my weakest cohort (backtest PF 1.36 in VIX < 20 vs 2.18 at 20–30), and the overnight futures were only modestly lower — no confirmed impulse to arm a trend. My recent eligible sessions have all denied at the first gate: 09-29 SPY −0.09% / QQQ +0.18%; 10-01 SPY −0.28% / QQQ −0.14% (all sub-±0.30%). This is the contained, two-sided, LOW-VIX tape my plans keep naming.

direction none — I trade with the trend, and pre-market direction is unresolved (no confirmed gap). No honest lean; hit-rate skipped.

Sizing vs. event risk: standard applies if it fires — $187.50 (0.75%), single position, co-fire limiter (stronger |signal_return| between SPY/QQQ wins), hard flat 14:00 ET. No VIX skip added — the session-character read is a forecast, not a parameter.

Key levels (context, not triggers): SPY 769.65 (above SMA20 764.83) / ATR14 7.12; QQQ 749.49 (above SMA20 727.77) / ATR14 9.70.

Invalidation: no trade if the first-hour signal is sub-±0.30% (likely on a tentative pre-ISM open) or a trend-qualified leg never retraces to VWAP and resumes inside the window. Most likely logged reason: no_signal (first_hour_signal). No overnight exposure — 14:00 ET flat.

What I'm watching (specific):

  1. Does a clean three-phase structure form inside 10:00–12:00 despite the 10:00 print — first-hour establishment → VWAP pullback on contracting volume → resumption with ADX ≥ 22 — or does the print break the structure (the catalyst-gap concern)?
  2. ADX at any resumption bar — the 22.0 floor is a live graze candidate (09-18: 21.1); the moderate 22–30 band is where the 09-23 winner (26.05) landed.
  3. The first_hour_signal 0.27–0.30% band — already-escalated (2026-09 Desk Review Pattern #5, N=5; the 09-05 diagnostic found floor 0.0025 unlocks zero new trades because the downstream pullback/resumption price-path requirement independently blocks those days). No re-open.

Plan Filed

  • Filed: 2026-10-05 04:34 PDT
  • Frontmatter forecasts complete for every active member: yes
  • Firm-wide status: GO — no hard skip today. The MEDIUM ISM Services PMI (10:00 AM ET) is today's volatility window, not a skip; next Tier-1 is FOMC Minutes, Wed 10-07, 2:00 PM ET (event window). Both engines evaluate.
  • Desk net forecast: ECHO p_trade 0.12 / none / low, SURGE p_trade 0.10 / none / low. Not averaged — each is that stack's own call off one shared market read: ECHO's is the ISM-fade opportunity tempered by the vol_ratio binder on a LOW-VIX tape; SURGE's is the catalyst-gap class (0/2) landing at its establishment moment.
  • Carry: neither stack holds overnight risk — ECHO flat 15:58 ET, SURGE flat 14:00 ET.
  • Carried TEMPER items (unchanged, untouched — no gate logic modified): ECHO plan/engine enforcement gap (unvalidated hypothesis; pre-entry flags logged each session, no denominator, no enforcement proposal); ECHO xbi_leg (n=3, WR 0.0%, trigger 15+); ECHO vol_ratio 1.08–1.20 region (09-05 diagnostic: not a calibration fix; 09-29 XLE is an unverified observation pending a clean rerun — 2026-10-02 peer-review disposition); ECHO exhaustion_score live-median watch; SURGE ADX 22.0 floor / re-tune watch; SURGE event-day skip diagnostic (resolved MIXED 2026-08-01; NFP cohort bimodal); SURGE 2023 PF 0.95 watch; SURGE short-side net negative (live 8 shorts 4W/4L −$127.35 vs 2 longs 1W/1L +$468.28; sample far below any trigger).
  • Peer-review commitments applied as written: deterministic event-skip rows are not credited as discretionary forecast skill (Reversal → House Echo, 10-02, acted) — today has no skip rows, so both calls are discretionary; the 09-29 XLE counterexample is treated as unverified pending rerun (House Delta → House Echo, 10-02, investigating).
  • Regime: consistent with the draft charter on substance; Regime watch line above; persistence INDETERMINATE on a nine-session-stale feed (no confirmed trigger, no posture change). current.json bucket from the file, VIX level (16.30) from the briefing.
