data-infra/regime/current.json — status: ok, as_of: 2026-09-22, i.e. stale by eight sessions (it lags 09-23, 09-24, 09-25, 09-28, 09-29, 09-30, 10-01 and today). Snapshot: spy_day flat, spy_open_to_close_pct −0.08% / spy_vs_sma50 above 50d / spy_drawdown_bucket <2% (spy_drawdown_pct −0.58%) / vix_regime LOW (<18), vix 14.21.^VIX is 15.97 (prior close 16.39) — LOW, ~2.0 points below the LOW/MID boundary at 18. I am not treating 14.21 as current.spy_vs_sma50 above 50d; spy_drawdown_bucket <2%; vix_regime LOW. The one live drift to name: SPY is below its 20-day mean (prior close 764.10 vs SMA20 765.01) while QQQ is well above (742.02 vs SMA20 726.18) — the same tech-led / broad-index split the last several sessions have carried. The spy_vs_sma50 tag is the one to watch; the stale file reads above.## Regime Charter: the charter is DRAFT — not ratified, and I am held to it as drafted. The draft's claim is that this desk does not need the market to go up: ECHO trades contra the day's direction, SURGE with it, both intraday and direction-agnostic. Today is a hard-skip session — the tape is untradeable by construction — so the plan neither needs nor refuses a rally. The plan is consistent with the draft on substance; it is not scored as charter-compliant (the charter is not ratified).spy_vs_sma50 = below 50d, no drawdown ≥ 2-5%, no vix_regime ≥ MID, and neither stack is near 10 consecutive no-fire sessions (ECHO last fired 09-23 → 6 no-fire sessions; today would be the 7th; SURGE last fired 09-28 → 3). No proposal, no posture change, watch only. Carried: if VIX closes ≥ 18 for 5 consecutive sessions the clause arms — I do not move a gate on regime evidence alone.is_hard_skip_day() skips {FOMC, CPI, NFP}; SURGE's is_event_day() skips any Tier-1 event day including NFP. Both plan-layer calls are stand-downs, and both are backed by a code-level skip. The two members are not averaged: ECHO carries a token non-zero for the plan/engine enforcement-gap tail (its engine has traded against plan intent before, 08-19/08-20); SURGE's skip is fully deterministic with no meaningful misfire tail.No trade expected — deterministic NFP hard skip, code-enforced, and no candidate universe exists today. p_trade 0.02, direction none, conviction high.
Strategy v7's Stage 1 Step 2 is unambiguous: "If any hard skip is flagged (FOMC/CPI/NFP/VIX≥30), the session is done — no evaluation, no trades." is_hard_skip_day() (agents/echo/paper_trade.py:341-348) skips {FOMC, CPI, NFP} — NFP is in the set. The engine has logged no_trade:hard_event:NFP correctly on every prior NFP session (07-02, 08-07 ×2, 09-04) and has never evaluated on one. The Scanner's Directional Catalyst Instruments section is N/A — there are literally no candidates to screen today.
p_trade 0.02 is the engine-honesty tail only, not a setup probability. It matches the desk's own 2026-09-04 NFP precedent (ECHO 0.02 / SURGE 0.0) and exists for one documented reason: the plan/engine enforcement gap — ECHO's engine traded XBI against plan intent on 08-19 and 08-20. A qualifying engine fire on an NFP NO-GO day would be a logging event and an enforcement-gap flag, never a validated setup. I am not lifting on the post-print participation story: the desk's "shock day lifts participation" hypothesis is 0-for-2 (09-24, 09-28) and is not re-run.
direction none — the skip preempts direction entirely (direction hit-rate is skipped for a none field). A post-NFP trending leg that exhausts by 15:20 is exactly the exhaustible program the mechanism is built to fade — and that is foregone by design, not a near-miss. The 08-14 learning ("no exhaustible program forms on LOW-VIX sub-ATR") and its inverse both apply, but neither licenses a trade through a Tier-1 skip.
Sizing vs. event risk: event risk HIGH, but not invoked — standard sizing (0.75% per instrument, 2.0% session budget ($500), stop 1.5× ATR(14, 5-min), hard flat 15:58 ET) applies only on a tradeable session; this is not one.
Key levels (context, not triggers): SPY 764.10 / range 758.82–765.63 / SMA20 765.01 (below) / ATR14 6.95. QQQ 742.02 / 736.25–744.65 / SMA20 726.18 (above) / ATR14 9.67 (QQQ is not my baseline universe — sector/rates context only). XLE — driver is crude, no EIA today; the brief has oil eased on European fuel-stock-release discussion but still Middle East-sensitive, so the energy leg's polarity is genuinely two-sided, which on any other day would leave the fade direction unresolved. XBI — no confirmed catalyst, not a candidate; the first-half-hour ≤ −5% hard skip stands if it ever evaluates.
Invalidation: already fully invalidated by the hard skip — there is no gate-clearing path. If I were to reconstruct the no-trade conditions: a two-sided, price-discovery NFP morning (no completed one-way program to exhaust), VIX 15.97 LOW (the cohort where vol_ratio blocks wide all stretch), and the chronic binder vol_ratio. Most likely logged reason: event:NFP (the code-level skip). No overnight exposure — 15:58 ET flat — the NFP print cannot be traded today, only gapped through.
Post-release structural question I am watching (the specific one, not filler): after the 8:30 print, does a Tier-1 labor release manufacture the participation ECHO's mechanism requires — a one-way program that holds to 15:20 with vol_ratio ≥ 1.2 and exhaustion_score ≥ 0.80 — or does the tape again print a wide morning signal on sub-floor volume? This is a foregone observation feeding the desk's 0-for-2 "shock day lifts participation" plan-layer hypothesis (N=2, below the Desk Review's N ≥ 3 bar — an observation, not an escalation). Secondary: does the reaction hold or reverse as yields respond (the briefing's stated fade-vs-chase fork)?
Pre-entry flags (peer-review commitment, applied as written): every engine fill is logged plan-endorsed / plan-evaluated / plan-declined, wins and losses alike. Still no denominator, so still no enforcement proposal — the plan/engine enforcement gap remains an unvalidated hypothesis and the plan-veto stays out of the gates. No gate logic is touched by anything in this plan.
No trade — deterministic NFP hard skip, baked into the locked v9 mechanism at the code level. p_trade 0.0, direction none, conviction high.
SURGE's cleared code calls is_event_day(trade_date, tier_filter=2) and skips any Tier-1 event day, logging no_trade:event: before any signal evaluation (agents/surge/paper_trade.py). NFP is explicitly in the hard-skip list (FOMC/CPI/NFP/PCE/QQQ-earnings — strategy_v2.md), and the skip has fired correctly on every prior NFP session (07-02, 08-07, 09-04). So this is not a session-character judgment — it is the mechanism's own locked event-day skip. p_trade 0.0: a code-level event-day skip on a named hard-skip date is the most certain no-trade call in SURGE's book; there is no meaningful misfire tail.
Even absent the skip, today is a poor fit. An NFP-open session is price-discovery, not a clean trend → measured pullback → resumption three-phase structure; the 07-24 learning has this catalyst-gap class at 0/2. VIX 15.97 LOW is its weakest cohort (backtest PF 1.36 in VIX < 20 vs 2.18 at 20–30), and the IEX pre-market shows no confirmed print, removing the impulse source.
The tension, stated honestly. SURGE's own event-day skip diagnostic (ratified MIXED 2026-08-01) found event-day trades profitable in both periods, with the NFP cohort bimodal (dev 3t PF 0.0 / holdout 3t PF 27.68) and QQQ_EARN the consistently strongest cohort — i.e., the blanket skip may be screening out cohorts that pay. That finding produced no live-path change (a per-type skip is a TEMPER conversation + a candidate for a targeted future backtest, never a unilateral tweak). The skip stands today.
Sizing vs. event risk: not invoked — standard $187.50 (0.75%), single position, co-fire limiter (stronger |signal_return| between SPY/QQQ wins), hard flat 14:00 ET applies only on a tradeable session. No VIX skip is added (the session-character read is a forecast, not a parameter).
Key levels (context, not triggers): SPY 764.10 (below SMA20 765.01) / ATR14 6.95; QQQ 742.02 (above SMA20 726.18) / ATR14 9.67 — QQQ carries the multi-session tech leadership. Both sit at/above a constructive backdrop were this a GO day; it is not.
Invalidation: already fully invalidated by the hard skip — there is no gate-clearing path at all. No overnight exposure — 14:00 ET flat.
Post-release structural question I am watching (the specific one): after the print, does a clean three-phase structure actually form inside 10:00–12:00 — a first-hour establishment that retraces to session VWAP on contracting volume and resumes with ADX ≥ 22 at the resumption bar? If it does, it is a foregone observation feeding the MIXED NFP-cohort question (was the skip leaving money on the table?), not a trade. If the tape stays directionless or a trend-qualified leg never retraces, that is the chronic pullback_resumption / first_hour_signal denial — structural absence rather than a threshold graze.
is_hard_skip_day() skips {FOMC, CPI, NFP} → event:NFP; SURGE is_event_day(tier_filter=2) skips any Tier-1 event day → event:NFP. Unlike 09-30 (PCE, which only SURGE skips), today both engines are out by their own locked rules.p_trade 0.02 / none / high, SURGE p_trade 0.0 / none / high. Not averaged: ECHO's 0.02 is the engine-honesty tail only (matches the desk's 09-04 NFP precedent), not a setup probability; SURGE's 0.0 is a fully deterministic code-level skip.xbi_leg (n=3, WR 0.0%, trigger 15+); ECHO vol_ratio sub-1.0 / 1.08–1.20 region (2026-09-05 diagnostic: not a calibration fix); ECHO exhaustion_score live-median watch; SURGE ADX 22.0 floor / re-tune watch; SURGE event-day skip diagnostic (resolved MIXED 2026-08-01; NFP cohort bimodal); SURGE 2023 PF 0.95 watch; SURGE short-side net negative (8 shorts 4W/4L −$127.35 vs 2 longs 1W/1L +$468.28; sample far below any trigger).Regime watch line above; no persistence trigger armed. current.json is stale by eight sessions — I state the bucket from the file and the VIX level (15.97) from the briefing. No trades taken.
Cadence rule header: Weekly/Friday or same-day-on-trade (WS5). Today is the Friday floor, and it is the desk's first floor-triggered reflection since the cadence change — no fill occurred in the window, so nothing else would have forced one. Period covered: 2026-09-29 → 2026-10-02 (four sessions) since the 09-28 reflection. Desk trade_count 0, desk net P&L $0.00, desk cumulative +$50.48.
Plan reference: desks/house-echo/plans/2026-09-29-plan.md … 2026-10-02-plan.md EOD briefing: dadbrain/Analysis/briefings/2026-10-02-eod.md
Four sessions, zero fills, and — for the first time in this desk's record — the forecast layer was the best-calibrated part of it. Both members forecast no-trade on all four sessions and were right every time: desk-period Brier 0.0954 (ECHO, four rows) and 0.0625 (SURGE, four rows), with two of the eight rows at essentially zero (the two NFP/PCE code-level skips, priced 0.0–0.02). That is a deliberate contrast to the 09-28 reflection, where SURGE's structure completed and the desk ate a 0.64 Brier on a losing fill. The tape this window was the desk's least-favourable structural character, four days running: a contained, LOW-VIX, two-sided price-discovery stretch where SPY and QQQ each closed within roughly one ATR of the prior close and the last hour was repeatedly near-flat. VIX closed the window at 15.31 (LOW) after sitting 15.97–16.39 across the four sessions; SPY ended 769.65 (+0.73%), QQQ 749.49 (+1.01%), both above their 20-day averages, on a news-driven session that closed positive versus the prior close but below the open.
The window had one Tier-1 event and it was the last day of it: NFP (September Employment Situation) at 8:30 AM ET on 10-02, a clear downside surprise (+29K vs +90K consensus; unemployment 4.2%; AHE +0.1%) that produced an initial relief bid, then a mild fade — the indexes finished above the prior close but below the open, final hour nearly flat. Both members hard-skipped it at the code level (no_trade:hard_event:NFP for ECHO; no_trade:event:NFP for SURGE). PCE on 09-30 was a second event day, and there the two members diverged in mechanism exactly as their plans predicted: SURGE's cleared code hard-skips PCE (no_trade:event:PCE); ECHO's does not — its is_hard_skip_day() skips {FOMC, CPI, NFP} only — so ECHO's engine evaluated in full and logged no_qualifying_instruments with per-instrument gate detail. That divergence was flagged in the 09-30 plan and is now confirmed live: it is a genuine firm-rule-vs-stack-rule difference, not a bug.
vol_ratio was the binding gate on the eligible sessions. The window's three eligible (non-event) sessions — 09-29, 09-30, 10-01 — produced nine instrument-sessions: vol_ratio bound 5 of them and morning_signal bound 4. The morning-signal blocks are the clean regime read: SPY −0.11% (09-29), XBI +0.04% (09-30), SPY +0.01% and XBI −0.18% (10-01) — all sub-±0.25% on a contained tape, structurally absent rather than narrowly missed. The vol_ratio blocks split the same way: three are wide (SPY 0.579 and XLE 0.676 on 09-30; XBI 0.936 on 09-29) and two are XLE near-misses — 09-29 at 1.088 (signal −0.74%) and 10-01 at 1.070 (signal +0.68%) against the 1.2 floor. XLE was the binding instrument on vol_ratio three consecutive eligible sessions (1.088 / 0.676 / 1.070), which is the same instrument the 2026-09 Desk Review found carrying 5 of 8 instances of its flagged 1.08–1.20 near-miss band. The 10-02 NFP skip was foregone by design, not a near-miss.first_hour_signal bound both legs on both of them. 09-29: SPY −0.09%, QQQ +0.18%. 10-01: SPY −0.28% — a 0.02pp miss against the ±0.30% floor, the tightest SURGE graze of the window — and QQQ −0.14%. The other two sessions were code skips (PCE, NFP). SURGE's own plan had named the denial shape precisely: "a near-flat open most likely leaves both sub-floor — today's key denial shape," and on 09-29 and 10-01 that is exactly what printed. Its 10-01 p_trade 0.20 was the window's one forecast above base rate, lifted on the tech-led futures tilt (Nasdaq-100 +0.77% vs S&P +0.36%); the tilt did not survive into a ≥0.30% first-hour impulse on either leg, and the Brier came in at 0.04 — a mild, honestly-earned miss, not a bust.Self-critique, both halves. ECHO's four no-trade forecasts were anchored below realized base rates and stayed there; the one thing to own is that the plan repeatedly named vol_ratio as the "likeliest late block" and it was — but the plan did not anticipate that XLE would be the single instrument sitting in the near-miss band three sessions running, which is the one part of this window that is not plain regime. SURGE's forecasts were, if anything, too pessimistic on 09-29 and too optimistic on 10-01 — the 10-01 lift on a tech-led tilt was the only place the plan reached above base rate, and the tilt did not convert. Neither stack touched a gate, and neither should have.

vol_ratio (5 of 9 eligible instrument-sessions), with morning_signal second (4 of 9). Reading REGIME, with one qualification that is not an escalationThe two binders divide cleanly, and the division is the whole finding:
morning_signal (4 of 9) — REGIME, structurally absent. Every one of these is a sub-±0.25% first-half-hour on a contained tape: SPY −0.11% (09-29), XBI +0.04% (09-30), SPY +0.01% and XBI −0.18% (10-01). A morning that never clears ±0.25% is not a threshold being grazed — there is no directional program to establish, and the desk's Regime Charter draft says the same thing in as many words ("a session with no program in it"). No fix, wait.vol_ratio (5 of 9) — REGIME on three, and a near-miss pair on XLE that belongs to an already-escalated pattern. The three wide misses are unambiguous: SPY 0.579 and XLE 0.676 (09-30, a −0.54% SPY day with a −0.58% final hour), and XBI 0.936 (09-29). The two XLE near-misses are the part worth stating precisely: 09-29 XLE vol_ratio 1.088 (signal −0.74%) and 10-01 XLE vol_ratio 1.070 (signal +0.68%), against the 1.2 floor — the same instrument that carried 5 of the 8 instances in the 2026-09 Desk Review's flagged 1.08–1.20 band, now binding on vol_ratio three consecutive eligible sessions. The qualification, and it is genuinely new. The 2026-09 Desk Review sized this pattern as a recalibration candidate, and the resulting diagnostic — agents/echo/deliverable_vol_ratio_floor_2026-09-05.{py,json} — was built and run on 2026-09-05, testing floors 1.2/1.1/1.05/1.0/0.9 across every logged day since 2026-06-22. Its verdict: the near-misses do not convert at floors 1.05 or 1.10 — zero new trades — because exhaustion_score (= vol_ratio × |signal_return|) independently blocks those days. That verdict was correct on its dataset. This window is the first time since then that a vol_ratio near-miss lands where the composite does not independently block:
vol_ratio 1.088 × |−0.74%| = exhaustion_score ≈ 0.805 — which clears the 0.80 floor. At a vol_ratio floor of 1.05, this day would newly qualify on both gates. It is the first instance I can find where loosening the floor to 1.05 would have produced a trade that the exhaustion composite does not also refuse — i.e. the 09-05 deliverable's stated blocking mechanism ("exhaustion_score independently blocks these days") does not hold for this day. This is not an escalation, and I am not touching a gate. The pattern is already escalated — the deliverable exists and is pending TEMPER's weekly backtest-audit cadence-ratification (the note is in agents/echo/CLAUDE.md). What the window adds is a single new data point relevant to that pending ratification: the deliverable's dataset predates 09-29, and 09-29 XLE is a case where its stated "exhaustion_score blocks regardless of floor" reasoning would not apply. The correct desk action is to say so plainly so TEMPER has it at ratification, not to build anything myself or re-open a floor conversation unilaterally. N=1 for the new shape — far below anything that would warrant a fresh deliverable. No gate touched, no unilateral tweak.
Regime or calibration? REGIME for the window; CALIBRATION-shaped but ALREADY-ESCALATED for the XLE pair. Four of the nine instrument-sessions are structurally absent mornings; three vol_ratio misses are wide; two are XLE near-misses inside a pattern the desk already escalated to a deliverable, one of which is a new counterexample to that deliverable's blocking reasoning. Nothing here is a reason to move a floor myself, and nothing here would have produced a trade worth wanting.
first_hour_signal (2 eligible sessions, both legs); the 10-01 SPY miss is 0.02pp and is already covered by a closed diagnosticSURGE did not trade, and unlike 09-28 there is no "the setup arrived and lost" story to tell — the setup was structurally absent on both eligible sessions:
The 10-01 graze is calibration-shaped on its face, and it is already answered. The 2026-09 Desk Review escalated exactly this pattern, and the diagnostic — agents/surge/deliverable_first_hour_floor_2026-09-05.{py,json} — was built and run on 2026-09-05, testing floors 0.0030/0.0025/0.0020/0.0015. Its verdict: the near-misses do not convert at floor 0.0025 — zero new trades — because the downstream pullback/resumption price-path requirement (ADX ≥ 22, correct VWAP side, a pullback that touches VWAP and resumes inside the window) independently blocks these days. A 10-01 SPY first hour of −0.28% would clear a 0.0025 floor but would still have to complete the three-phase structure, and a contained −0.03% SPY day is precisely the price-discovery tape that denies it. So the 10-01 miss adds an instance to the already-escalated pattern; it does not change the pattern's sizing. No gate touched, no re-opening of the closed first-hour-floor question.
One carried observation, unchanged: the 09-28 counter-instance to the 2026-07-24 "catalyst-gap days are structurally untradeable" reading (a gap-down, catalyst-driven session did complete the three-phase structure and still lost) remains attached to the session-character/catalyst-gap conversation. This window adds nothing to it — it was too contained to form the structure at all.
Regime or calibration? REGIME for the window (both eligible sessions were sub-floor on both legs with no structure forming). The 10-01 0.02pp SPY graze is calibration-shaped but ALREADY-ESCALATED and ALREADY-ANSWERED by the 09-05 deliverable — regime, no action.

Narrative finding. This window is the desk's well-calibrated quiet side, and after six weeks of reflections explaining no-print streaks as "the setups were absent and that is fine," the honest new sentence is that this stretch genuinely was that, with one exception. Both members forecast no-trade on all four sessions and were right every time — the forecast layer earned its keep, and the desk should record that as plainly as it records the misses. The one exception is the XLE vol_ratio pair: not because it should have traded, but because it is the first data the desk has produced since the 09-05 deliverable that bears on that deliverable's own stated reasoning. The distinction the desk has been careful about — "regime, no escalation" versus "calibration, evidence for a TEMPER conversation" — now has a third, subtler case: already-escalated, and the window adds a qualifying data point to the pending ratification. That is a real finding and it belongs in the record without being dressed up as a new escalation.
Regime watch: data-infra/regime/current.json — status: ok, as_of: 2026-09-22, i.e. stale by eight sessions (it lags 09-23, 09-24, 09-25, 09-28, 09-29, 09-30, 10-01 and today). Snapshot: spy_day flat, spy_open_to_close_pct −0.08%, spy_vs_sma50 above 50d, spy_drawdown_bucket <2% (spy_drawdown_pct −0.58%), vix_regime LOW (<18), vix 14.21. Live levels from the briefings, not the stale file: VIX 15.31 (close, −1.08 vs 16.39) — LOW, ~2.7 points under the LOW/MID boundary at 18; SPY 769.65 above SMA20 764.83; QQQ 749.49 above SMA20 727.77. Across the whole window VIX sat 15.97–16.39, never near the LOW/MID boundary. None of the three shared tags is in a stressed state. Against the desk's ## Regime Charter — still DRAFT, not ratified, and I am held to it as drafted — the window is charter-consistent on substance: the desk does not need the market to go up (ECHO fades the day's direction, SURGE rides it, both intraday and direction-agnostic), and on the four sessions neither stack was fed a rally it required — the tape simply never formed the directional program either expression needs. Persistence rule: not armed. No 5-session stretch in a stressed tag state; ECHO is 7 no-fire sessions into a 10-session trigger (last fired 09-23), and SURGE is 4 (last fired 09-28). If VIX closes ≥ 18 for 5 consecutive sessions the clause arms, or if a stack fires no trades across 10 consecutive sessions — ECHO is the one approaching that, at 7 of 10, and I am watching it. On persistence I file through the Desk Review shapes; I do not move a gate on regime evidence alone. No proposal, no posture change, watch only.
vol_ratio floor (1.2): ALREADY ESCALATED; window adds one qualifying data point. The 2026-09 Desk Review sized the 1.08–1.20 near-miss pattern (N=8, concentrated on XLE) as a recalibration candidate; the 2026-09-05 deliverable was built and found floors 1.05/1.10 unlock zero new trades because exhaustion_score blocks independently. New this window: 09-29 XLE (vol_ratio 1.088, signal −0.74%, exhaustion_score ≈ 0.805 — clears) would newly qualify at a floor of 1.05, the first instance where the deliverable's stated blocking mechanism does not hold. 10-01 XLE (1.070, exhaustion 0.728) confirms the old mechanism. The deliverable's dataset predates 09-29 — recommend it be re-run through the current date before TEMPER ratifies. N=1 for the new shape; no new deliverable, no gate touched.xbi_leg sub-book: n=3, WR 0.0%, PF 0.0. Exclusion review triggers at 15+ live trades — not triggered. The open 09-18 XBI-specific vol_ratio question stays N=2 (09-17 1.120, 09-18 1.187 with exhaustion clearing); XBI blocked at 0.936 (09-29, wide) and on morning_signal (09-30, 10-01) this window, so the question is neither advanced nor closed.no_qualifying_instruments, not hard_event:PCE), exactly as the 09-30 plan predicted. This is a stack-rule fact, not a bug, and not an enforcement-gap instance.exhaustion_score live-median watch: unchanged, still far from the 40-trade validation point. vol_ratio ≥1.5-tier discrimination watch (N=1): unchanged.intelligence/runner-health-2026-{09-29,09-30,10-01,10-02}.md all read CLEAR — both echo and surge completed and wrote daily artifacts on every session in the window.score_plans.py): unchanged — SURGE's direction frontmatter is not an input to its signal (direction resolves at evaluation time), so the direction-hit field remains a scoring artifact for that stack. Proposed for TEMPER's consideration, never applied unilaterally.Flag for learnings.md: house-echo / ECHO — over the 2026-09-29 → 2026-10-02 window, vol_ratio was the binding gate on 5 of 9 eligible instrument-sessions (with morning_signal on 4 of 9, all sub-±0.25% contained-tape mornings — structurally absent, regime). The vol_ratio misses split into three wide blocks (SPY 0.579 / XLE 0.676 on 09-30; XBI 0.936 on 09-29) and two XLE near-misses in the 2026-09 Desk Review's already-escalated 1.08–1.20 band — XLE 1.088 (09-29, signal −0.74%) and XLE 1.070 (10-01, signal +0.68%), XLE binding on vol_ratio three consecutive eligible sessions. The load-bearing new datum: 09-29 XLE's exhaustion_score = 1.088 × 0.74 ≈ 0.805, which CLEARS the 0.80 floor — so at a vol_ratio floor of 1.05 this day would newly qualify on both gates. That is the first instance since the 2026-09-05 deliverable (agents/echo/deliverable_vol_ratio_floor_2026-09-05.{py,json}) where that deliverable's stated blocking mechanism ("exhaustion_score independently blocks these near-miss days regardless of the vol_ratio floor") does not hold — the deliverable's dataset predates 09-29. The companion instance (10-01 XLE 1.070 × 0.68 = 0.728) confirms the old mechanism. Reading: the window itself is REGIME (no gate change, no new deliverable); the XLE pair is CALIBRATION-shaped but ALREADY-ESCALATED — the deliverable exists and is pending TEMPER cadence-ratification, so the correct action is to surface the 09-29 instance at ratification and recommend the deliverable be re-run through the current date, not to build anything or move a floor. No gate touched.
Flag for learnings.md: house-echo / SURGE — over 2026-09-29 → 2026-10-02, first_hour_signal was the binding gate on both eligible sessions and both legs (09-29: SPY −0.09%, QQQ +0.18%; 10-01: SPY −0.28% — a 0.02pp miss — and QQQ −0.14%, floor ±0.30%); the other two sessions were code-level event skips (PCE 09-30, NFP 10-02), logged correctly. The 10-01 SPY miss falls in the already-escalated 0.27–0.30% near-miss band (2026-09 Desk Review Pattern #5, N=5 across five weeks), and the 2026-09-05 deliverable (agents/surge/deliverable_first_hour_floor_2026-09-05.{py,json}) already found floor 0.0025 unlocks zero new trades because the downstream pullback/resumption price-path requirement (ADX ≥ 22, correct VWAP side, a VWAP-touch pullback that resumes inside the window) independently blocks these days. Reading: REGIME — the pattern is already escalated and already answered; this instance does not change its sizing, and the closed first-hour-floor question is not re-opened. No gate touched. The window's forecasts were the desk's best-calibrated of the stretch (SURGE period Brier 0.0625, all four no-trade calls correct).
Friday-cadence reflection for 2026-09-29 → 2026-10-02 — desk net $0.00, four sessions, zero fills, desk cumulative +$50.48. Desk-period forecast layer was the desk's best of the stretch: both members forecast no-trade on all four sessions and were right every time (ECHO period Brier 0.0954, SURGE 0.0625). ECHO 0 trades: vol_ratio bound 5 of 9 eligible instrument-sessions (with morning_signal on 4 of 9, all sub-±0.25% contained mornings), three wide blocks (SPY 0.579 / XLE 0.676 / XBI 0.936) and two XLE near-misses in the already-escalated 1.08–1.20 band (1.088 on 09-29, 1.070 on 10-01). Verdict: REGIME — no gate change. One qualification, not an escalation: 09-29 XLE would newly qualify at a vol_ratio floor of 1.05 and clear exhaustion_score (≈0.805), the first instance where the 09-05 deliverable's "exhaustion blocks regardless" reasoning does not hold — recommend that already-built, TEMPER-pending deliverable be re-run through the current date before ratification. SURGE 0 trades: first_hour_signal bound both legs on both eligible sessions; 10-01 SPY −0.28% is a 0.02pp miss in the already-escalated 0.27–0.30% band, and the 09-05 deliverable already answered it (floor 0.0025 → zero new trades; downstream structure blocks). Verdict: REGIME — no gate change, closed first-hour-floor question not re-opened. Both stacks hard-skipped NFP (10-02); the 09-30 PCE session confirmed the firm-rule-vs-stack-rule divergence (SURGE code-skips PCE; ECHO's code does not and evaluated in full) — a stack-rule fact, not a bug. Desk cumulative +$50.48; SPRT unchanged (ECHO LLR −0.082, n=13, 46.2%, CONTINUE; SURGE LLR +1.414, n=10, 50.0%, CONTINUE). Regime watch: current.json as_of 2026-09-22, stale by eight sessions; no shared tag stressed (spy_vs_sma50 above 50d, spy_drawdown_bucket <2%, vix_regime LOW with live VIX 15.31); charter-consistent on substance, persistence rule not armed (ECHO 7 of 10 no-fire sessions — approaching the trigger; SURGE 4), no posture change. Two flags filed for learnings.md (one per member); runner health CLEAR all four sessions.
