Regime Watch

  • Read: data-infra/regime/current.json — status: ok, as_of: 2026-09-22, i.e. stale by seven sessions (it lags 09-23, 09-24, 09-25, 09-28, 09-29, 09-30 and today). Snapshot: spy_day flat, spy_open_to_close_pct −0.08% / spy_vs_sma50 above 50d / spy_drawdown_bucket <2% (spy_drawdown_pct −0.58%) / vix_regime LOW (<18), vix 14.21.
  • Staleness handling: I take the bucket from the file and the level from the briefing. Live ^VIX is 16.25 (prior close 16.34) — LOW, ~1.75 points below the LOW/MID boundary at 18. I am not treating 14.21 as current.
  • Charter indicators moving: none of the three shared tags is in a stressed state. spy_vs_sma50 above 50d; spy_drawdown_bucket <2%; vix_regime LOW. The one live drift to name: SPY is below its 20-day mean (prior close 762.34 vs SMA20 765.06), while QQQ is well above (739.51 vs SMA20 724.54) — the tech-led/rotation split the futures bias echoes. The spy_vs_sma50 tag is the one to watch; the stale file reads above.
  • Consistency with the desk's ## Regime Charter: the charter is DRAFT — not ratified, and I am held to it as drafted. The draft's claim is that this desk does not need the market to go up: ECHO trades contra the day's direction, SURGE with it, both intraday and direction-agnostic. Today's read — a mixed, news-driven, two-sided tape with a tech-led futures tilt — feeds neither stack a required rally. The plan is consistent with the draft on substance; it is not scored as charter-compliant (the charter is not ratified).
  • Persistence rule: not armed. No spy_vs_sma50 = below 50d, no drawdown ≥ 2-5%, no vix_regime ≥ MID, and neither stack is near 10 consecutive no-fire sessions (ECHO last fired 09-23 → 5 no-fire sessions; today would be the 6th; SURGE last fired 09-28 → 1). No proposal, no posture change, watch only. Carried: if VIX closes ≥ 18 for 5 consecutive sessions the clause arms — I do not move a gate on regime evidence alone.

Shared Market Read

  • Event risk today: HIGH in the briefing's rating, but the HIGH is tomorrow's — NFP is 2026-10-02 at 8:30 AM ET (BLS-confirmed; the September 2 continuing resolution funds agencies through December 11, so no lapse invalidates the date). Today's own calendar is MEDIUM: 8:30 jobless claims (200K cons / 197K prior), 9:05 Fed speakers (Barkin, Collins, Schmid), 9:45 S&P Global mfg PMI final (57.0), 10:00 ISM mfg PMI (~55.0), 10:00 construction spending, and NKE Q1 FY2027 earnings after the close. No Tier-1 release today. Firm-wide trade status GO — no hard-skip condition.
  • Session character expected: mixed / news-driven, contained start more likely than a one-way index trend. The 9:45–10:00 manufacturing data sequence can reset the morning's structure; keep the initial reaction distinct from any post-release follow-through. The briefing's discipline is explicit: momentum needs a clear post-data hold and breadth rather than a first impulse alone.
  • VIX regime: 16.25 — LOW (<18), −0.09 vs the 16.34 prior close. LOW is the weakest cohort for both members — ECHO needs a completed, high-participation program to have something to exhaust, and SURGE's backtest PF is 1.36 in VIX < 20 vs 2.18 at 20–30. Neither stack has a VIX parameter (ECHO's skip is a first-half-hour |return| proxy, 1.8%; SURGE has no VIX skip), so this is a forecast input, not a gate.
  • Key levels: SPY prior close 762.34 (prior range 762.24–769.41; SMA20 765.06 — below; ATR14 7.07). QQQ prior close 739.51 (prior range 739.46–745.07; SMA20 724.54 — above; ATR14 9.70). Trailing ATR is normal, so an open beyond roughly ±0.5% (SPY ≈ 3.8 pts, QQQ ≈ 3.7 pts) would be a genuine gap; the briefing reports no confirmed liquid pre-market print on the IEX feed (confirm the gap at the open). XLE has no authoritative briefing level; the driver line is crude — lower overnight on recovering Middle East exports and a 922K-barrel US build, but volatile on unresolved supply headlines; no EIA print today (EIA is Wednesday; the latest was Sep 30). XBI — no verified FDA/PDUFA decision for Oct 1; not a candidate.
  • Macro backdrop: the market is balancing the prior session's softer core PCE against firm consumer spending and an upwardly revised GDP; higher long-end yields and renewed oil uncertainty are limiting the inflation-relief interpretation. Tomorrow's labor report is the next Tier-1 catalyst.
  • Futures / cross-asset (watchlist, 6:53 ET): S&P 500 futures +0.36%, Nasdaq-100 +0.77%, Dow +0.06% — a tech-led futures bias, not a verified cash-session gap. Micron's FY26 Q4 report (after Sep 30 close) plus record South Korean chip exports give an AI-memory read-through; US follow-through is unconfirmed. Crude retreated overnight; energy is not a clean directional catalyst.
  • Desk-level consequence. This is a normal eligible session for both stacks — no Tier-1 hard skip today (NFP is tomorrow; the QQQ-earnings calendar has no Oct-1 entry). Both engines will evaluate. The tape is the desk's least-favourable structural character (two-sided price-discovery, LOW-VIX), and the chronic binders are the ones to watch: ECHO vol_ratio, SURGE first_hour_signal / pullback_resumption. The two members do not share the same skip mechanism, but today neither is skipped, so both are genuine forecasts.

ECHO — dynamic universe (SPY/XLE/XBI baseline), close-leg exhaustion fade at 15:30 ET

Setup possible but unlikely — small non-zero, below base rate. p_trade 0.15, direction none, conviction low.

Eligible, and the engine will run. Today is not FOMC/CPI/NFP, prior VIX is 16.25 < 30, and no mega-cap constituent reported after the prior close — so is_hard_skip_day() is clear and the gate stack evaluates SPY/XLE/XBI in full at 15:20.

Why 0.15, below every realized rate. From intelligence/plan-calibration.csv: 10 fires / 53 scored sessions ≈ 0.19 all-time; 2 / 10 over the last ten = 0.20; 1 / 6 over the last six eligible (non-event) sessions ≈ 0.17. I sit at the low end of that range, for three reasons: (1) VIX 16.25 LOW is my weakest cohort — the mechanism needs a completed, high-participation all-day program to have something to exhaust, and a sub-ATR LOW-VIX tape does not form one; (2) the briefing's mixed/news-driven, price-discovery character is the opposite of the orderly one-way program my gates confirm; (3) the chronic binder is vol_ratio, which has printed sub-floor on five consecutive sessions (SPY 1.166 → 0.998 → 1.102 → 1.088 → 0.579 vs the 1.2 floor) with morning_signal the secondary block. I am not lifting on the 9:45/10:00 manufacturing data: the desk's "shock day lifts participation" hypothesis is 0-for-2 (09-24, 09-28) and is not re-run.

direction none. My entry is contra the observed morning signal, which does not exist yet, and the briefing refuses a directional call on a mixed tape; a pre-committed sign would be a guess. Direction hit-rate is skipped for a none field.

Sizing vs. event risk: event risk HIGH, but it resolves tomorrow at 8:30, and my 15:58 ET hard flat means nothing survives a headline or the session. No event-driven size reduction — and not invoked: standard sizing (0.75% per instrument, 2.0% session budget ($500), stop 1.5× ATR(14, 5-min), flat 15:58) applies only if the engine clears.

Key levels (context, not triggers): SPY 762.34 / range 762.24–769.41 / SMA20 765.06 (below) / ATR14 7.07. QQQ 739.51 / 739.46–745.07 / SMA20 724.54 / ATR14 9.70 (QQQ is not my baseline universe — sector/rates context only). XLE — driver is crude, no EIA today; a lower crude overnight argues energy is the weak leg, so an up-morning energy fade would be the disallowed side of my 08-10 driver rule (fade the driver's own strengthening sector = loss template); a down-morning XLE is the allowed side. XBI — no confirmed catalyst, not a candidate; the hard skip stands if first-half-hour ≤ −5%.

Invalidation: stand down entirely if (1) every candidate is sub-±0.25% in the first half hour — the modal two-sided-tape case; (2) vol_ratio < 1.2, ADX < 20, or exhaustion_score < 0.80 at 15:20 — the standard wide block; (3) crude reverses and energy becomes the strong leg — XLE flips to the disallowed fade side, re-evaluate; (4) XBI first-half-hour ≤ −5% (hard skip). Most likely logged reason: vol_ratio or morning_signal. No overnight exposure — 15:58 ET flat — NFP tomorrow cannot be traded today, only gapped through.

What I'm watching (the specific one, not filler): (1) does the 8:30 claims + 9:45/10:00 PMI sequence seed a one-way program that holds to 15:20 with vol_ratio ≥ 1.2 (and exhaustion_score ≥ 0.80) on SPY or XLE, or does the tape again print a wide morning signal on sub-floor volume? (2) whether the tech-led futures tilt broadens into SPY breadth or stays a rotation that leaves the broad index without a program; (3) XLE's reaction to the lower overnight crude — weak-leg energy is the allowed fade, strong-leg is not.

SURGE — SPY/QQQ, VWAP pullback resumption (10:00–12:00 ET)

Setup possible, marginally above base rate on the tech-led futures tilt. p_trade 0.20, direction long, conviction low.

Eligible, and the engine will run. NFP is tomorrow, not today, so the Tier-1 skip is clear; qqq_earnings_dates.csv has no Oct-1 entry (its coverage ends 2026-06-03, and MU is not in the mega-cap skip list); no FOMC/CPI/PCE. is_event_day() returns false and SURGE evaluates SPY and QQQ.

Why 0.20, at the top of the recent range. Base rate: 7 fires / 53 scored ≈ 0.13 all-time; 2 / 10 over the last ten = 0.20. I sit at the upper end on one specific input: the tech-led futures bias (Nasdaq-100 +0.77% vs S&P +0.36%) is a genuine candidate for a first-hour establishment over the ±0.30% floor on QQQ — which is SURGE's most common binder (first_hour_signal). If an impulse forms and holds after the data, the three-phase structure becomes reachable.

Why not higher. The 9:45/10:00 manufacturing PMIs land inside the establishment/entry window, and the briefing is explicit that momentum needs a clear post-data hold and breadth rather than a first impulse — a price-discovery open is not SURGE's clean three-phase structure (the 07-24 learning has the catalyst-gap class at 0/2). VIX 16.25 LOW is SURGE's weakest cohort (backtest PF 1.36 in VIX < 20 vs 2.18 at 20–30), and the chronic binder is pullback_resumption — a trend-qualified leg that never retraces to VWAP.

direction long. If a trade fires it is more likely the tech-led up-leg (QQQ leads, above its 20-day mean, with the futures tailwind). This is a genuine lean, not a fence — direction resolves at evaluation time and is not a gate.

Sizing vs. event risk: event risk HIGH (tomorrow's NFP), but SURGE is flat by 14:00 ET, so nothing survives the close. No event-driven size reduction — and not invoked: standard $187.50 (0.75%), single position, co-fire limiter (stronger |signal_return| between SPY/QQQ wins), hard flat 14:00 ET applies only if it fires.

Key levels (context, not triggers): SPY 762.34 (below SMA20 765.06) / ATR14 7.07; QQQ 739.51 (above SMA20 724.54) / ATR14 9.70 — QQQ is the leg with the futures tailwind. An open beyond ≈ ±0.5% would be a genuine gap; the pre-market print is thin, so confirm at the open.

Invalidation: stand down if (1) neither leg prints a ±0.30% first-hour impulse — the modal case on a contained, direction-unknown open; (2) a leg trend-qualifies but no VWAP-touch pullback resumes inside the window — the chronic pullback_resumption block; (3) the PMI prints at 9:45/10:00 fracture rather than retrace the first-hour drive (my documented loss class); (4) ADX < 22 at any resumption bar. Most likely logged reason: first_hour_signal or pullback_resumption — structural absence, not a threshold graze. The first-hour-floor question stays closed (the 2026-09-05 deliverable: zero new trades unlock at floor 0.0025). No overnight exposure — 14:00 ET flat.

What I'm watching (the specific one): (1) does QQQ hold a first-hour up-establishment through the 9:45/10:00 PMI prints, or does the data fracture the open impulse into chop? (2) does a VWAP-touch pullback form on contracting volume inside 10:00–12:00 and resume — the precondition that blocked 09-10, 09-21 and 09-22? (3) ADX ≥ 22 at any resumption bar — the moderate 22–30 band is where the 09-23 winner (26.05) landed; 09-28's loser sat in the strong band (34.53).

Plan Filed

  • Filed: 2026-10-01 04:38 PDT
  • Frontmatter forecasts complete for every active member: yes
  • Firm-wide status: GO — no Tier-1 hard skip today; NFP is tomorrow (Oct 2, 8:30 AM ET). Both engines evaluate.
  • Desk net forecast: ECHO p_trade 0.15 / none / low, SURGE p_trade 0.20 / long / low. Not averaged: ECHO sits below its 0.19 all-time / 0.20 recent-ten on the LOW-VIX weakest-cohort read and a five-session vol_ratio denial; SURGE sits at its recent-ten top on the tech-led futures tilt, capped by the PMI data landing inside its window.
  • Carry: neither stack holds overnight risk — ECHO flat 15:58 ET, SURGE flat 14:00 ET — so tomorrow's NFP cannot be traded today, only gapped through; next Tier-1 after that FOMC minutes Oct 7.
  • Carried TEMPER items (unchanged, untouched — no gate logic modified): ECHO plan/engine enforcement gap (unvalidated hypothesis; pre-entry flags logged each session, no denominator, no enforcement proposal); ECHO xbi_leg (n=3, WR 0.0%, trigger 15+); ECHO vol_ratio sub-1.0 / 1.08–1.20 region (2026-09-05 diagnostic: not a calibration fix); ECHO exhaustion_score live-median watch; SURGE ADX 22.0 floor / re-tune watch; SURGE event-day skip diagnostic (resolved MIXED 2026-08-01); SURGE 2023 PF 0.95 watch; SURGE short-side net negative (8 shorts 4W/4L −$127.35 vs 2 longs 1W/1L +$468.28; sample far below any trigger).
  • Plan-layer item carried (not an escalation — N=2, below the N ≥ 3 bar): ECHO's "shock day lifts participation" forecast hypothesis is 0-for-2 and is not used to lift today's number.
  • Regime: consistent with the draft charter; Regime watch line above; no persistence trigger armed. current.json is stale by seven sessions — I state the bucket from the file and the VIX level (16.25) from the briefing.
