data-infra/regime/current.json (ASSAY, status: ok, as_of: 2026-09-22) — six sessions stale, read as reported: spy_day: flat · spy_open_to_close_pct: −0.08 · spy_vs_sma50: above 50d · spy_drawdown_bucket: <2% (spy_drawdown_pct −0.58) · vix_regime: LOW (<18) (vix 14.21). The file is now six sessions behind (09-23 → 09-30). Its VIX (14.21) versus the briefing's live 16.08 is a +1.87-point live-vs-file gap; both still sit in LOW (<18), so the regime label survives the lag, but a six-session-old file carries no authority today and I will not let it carry the read.
Charter consistency — consistent, with two indicators moving. Status corrected first, because I mislabelled it twice: the desk CLAUDE.md ## Regime Charter reads Status: DRAFT — not ratified, and both the 09-25 plan and reflection called it "my ratified Regime Charter." That was my drafting error (accepted in the 09-25 peer-review disposition) and it does not recur here: this is a draft charter and a consistency verdict is a self-check against unratified text. Of its indicators, spy_vs_sma50 = above 50d and spy_drawdown_bucket = <2% are the live state the draft describes (with the honest asymmetry it records — above-50d is the inferential bucket, N=42, and it is the one I sit in). vix_regime = LOW is the bucket in which my gate is silent by design; a step up the ladder is what the charter says I want, not a threat. Two things are genuinely moving. (1) My own exceedance rate — re-measured this session on my own verified pipeline at the fixed 4.970946% threshold: dev (2020–2023) 15.010% (151/1,006 windows), trailing-60 0/60 = 0.00% (0.00×), trailing-250 11/250 = 4.400% (0.29×) — a sixth consecutive direct measurement short of the dev rate (all-window form). (2) The shared VIX tag's direction — 16.08 is still well under the charter's own MID (≥18) shift condition; one session up and one down is a level wobble, not a regime change, and the persistence rule (5 consecutive sessions in the new state) has not begun to run.
Today's plan — stand flat, change nothing — is consistent with the draft charter. On the exceedance reading the persistence rule is satisfied many times over, so it belongs in a proposal through the Desk Review shape (next monthly review), not in a unilateral move here. Watch and report only: I change no gate, no sizing, no posture, no script on a regime signal.
load_daily_through(), 2,197 daily rows through 09-29) rather than borrow or manufacture a print — and there is no IWM pre-market print available to me, so today's gap is inferred, not observed. IWM 09-29 close 279.21 (open 280.26, high 281.05, low 277.41 — a −0.314% session and a fresh 20-session low close and low); prior closes 280.09 (09-28), 282.17 (09-25), 281.67 (09-24), 282.03 (09-23), 287.21 (09-22), 285.62 (09-21), 284.18 (09-18), 285.33 (09-17). Trailing-20 closes 279.21–295.92, high 296.18, low 277.41; trailing-60 closes 279.21–305.01, high 305.18 → live structural refs ~$277–279 floor / ~$296 ceiling. Trailing-20 daily ATR 3.089 (~1.11% of close). Flat book — state/position_ledger.json → {"open_position": null}.State-machine leg, stated plainly first because it is the leg the desk is built to report. agents/slack/state/position_ledger.json reads {"open_position": null}. Two of my three branches are dead on arrival: nothing is held, so no hold-silently marker today, and nothing to close, so no close-and-log due — no day-1..5 counter is running because no cycle was ever opened. Today is day 0 of a cycle that has not started: not an open day, not a hold day, not a close day — a no-signal day, and today's action is to stay flat and log no_trade:no_signal. The one branch that can log a real trade is an entry at today's open, gated by the run settling at the last completed close — the run ending 09-29's close, measured this session on my own pipeline at −2.7854% (279.21 / 287.21 − 1) against ±4.970946%. That is 2.19pp short on the down leg; the up leg is nowhere near either. Today's open is closed mechanically and my call is exact rather than probabilistic: p_trade 0.0, direction none, conviction high.
Scoreboarding my own last call, honestly. The 09-29 plan bounded the roll and predicted −2.4790% for a flat close at 280.09, and called no flag at 09-29's close → no 09-30 entry. IWM printed 279.21, so the run settled −2.7854%: direction right, no-trade call right, roll bound 0.31pp off — the session fell a further 0.314% below the flat-close assumption. The technique (bound the roll, committed 09-11) remains the right one; today it again under-shot a down move, the honest failure direction for a bound that assumes a flat close.
What would have to happen at today's close to matter at all. An entry at Thursday 10-01's open needs the run ending today's close to cross. The window's base rolls down from 287.21 (09-22) to 282.03 (09-23), so the dropped session pushes the reading shallower before a tick of today's tape prints — a flat close at 279.21 already reads only −0.9999%. Against the ±4.970946% flag: an up-flag needs a close ≥ 296.05 — a +6.03% session; a down-flag needs ≤ 268.01 — a −4.01% session. For scale, trailing-20 daily ATR is 3.089, about 1.11% of spot — so the down-flag asks for ~3.6σ in a single session and the up-flag ~5.4σ. On a news-driven two-sided tape around PCE with no IWM print of its own, my call: no flag settles at today's close either. And I give the mechanic, not just the level: the reading moves on window composition — a large session rolling off the back travels it 2–3pp on a sub-1% tape, and today it rolls with me by ~1.8pp (287.21 → 282.03), which is why the flat-close reading is only −1.00%.
The firm's NO-GO rule — does it bind me today? Not in effect, and I say why rather than wave at it. SLACK's locked mechanism carries no event-day gate of its own (strategy_v2.md Rule 6: no stop, no target, no early exit — and no calendar override). The firm's deterministic Tier-1 rule is therefore the only thing that could stop an event-day entry, and on a day a flag settled on a Tier-1 print it would skip the entry. Today it is moot: my book is flat and the gate is not crossed, so there is no entry candidate for the rule to skip. If a flag had settled at 09-29's close, the NO-GO would have skipped the entry and the honest report would read "signal fired, entry suppressed by firm calendar" — it did not fire. The rule binds nothing here today; my flatness is mechanical, not calendar-driven.
Setup present: no — mechanically excluded at today's open, and not plausibly reachable at today's close. Sizing vs. event risk: nothing to size today, and no override exists to apply. With p_trade 0.0 there is no notional, no entry window and no exit to adjust. The locked parameters stand unchanged: 15% of equity as fixed notional (≈$3,750 on the $25K account), single position at a time, no stop-loss, no profit target, no early exit. Today's HIGH event risk has no purchase on the size and no role in the exit — but the hold-spanning-event question is live again (any flag this week would carry NFP 10-02 and FOMC Minutes 10-07), so I answer it explicitly rather than lean on the rule: there is no event-day override in the locked design, a flag this week would hold the 15% notional through those prints by construction, not by choice, and I will not invent a discretionary skip — that is a strategy change and it is TEMPER's, not mine. The sizing is calibrated for exactly this class (the March 2020 COVID-week long, −19.66% of notional ≈ −3% of equity); event risk is a carry cost here, not a gate input.
Session-character fit: poor for intraday structure, irrelevant to me — and I say so instead of manufacturing a view. I have no intraday component: I check IWM once, at the open, and hold for five sessions. A Tier-1 binary at 8:30, VIX pinned in LOW, no IWM pre-market print, and two index legs split across their 20-day SMAs are precisely the conditions that do not manufacture a 5-day ±4.97% extent. This is now 62 consecutive logged no-signal sessions through 09-29 (07-02 → 09-29 unique; the duplicate 08-07 row stays flagged for cleanup and is not counted), and today would make it 63 once logged. The most recent settles are −0.65% (09-23) → −1.28% (09-24) → −0.71% (09-25) → −1.94% (09-28) → −2.79% (09-29) — the deepest of the recent run, but still 2.19pp short, and the window's whole spread remains inside ±2.8%. The closest Phase 3 reading remains 09-16's −3.21% (1.76pp, a single isolated print that receded within two sessions); the deepest positive remains +3.92% on 08-06 (1.05pp). No cluster in either the −4.0%→−4.97% or the +4.0%→+4.97% band, in 62 logged sessions. SPRT at n=0, W0/L0, LLR +0.000, both boundaries (±2.944) untouched, sprt.json updated through 09-29 — and by construction it cannot flag at n=0, which is exactly why the exceedance test exists beside it. I want the flag; I do not expect it.
Key levels and invalidation. The binding level is the ±4.970946% 5-day run threshold, full stop; every other level is context. Measured structural refs: ~$277–279 floor (09-29 low 277.41 and close 279.21, both fresh 20-session lows) / ~$296 ceiling (trailing-20 high 296.18; 60-day high 305.18). A decisive break of the floor is the realistic route to a down-flag (→ contrarian long) — but the gate needs a 5-session extension, not one gap-down day: even a −1.0% close today prints the run at only ~−2.0%, still ~3pp short, because the base rolls down to 282.03 and helps me. Invalidation for today: none applies — flat, no entry reachable at either the open or a plausible close, no scheduled exit, nothing held into the 8:30 print or the 10:00 release.
Rolling exceedance — sixth consecutive measurement, and the only live falsifier this stack has; the raw-count form is now being retired. Measured this session on my own verified pipeline with the threshold held at 4.970946%: dev-period (2020–2023) exceedance rate 15.010% (151/1,006 windows); trailing-60: 0 of 60 → 0.00% (0.00×); trailing-250: 11 of 250 → 4.400% (0.29×). But the 09-25 peer-review disposition committed me to retiring the raw-window form, because overlapping 5-day windows are autocorrelated and a raw count overstates precision in one direction and understates it in the other. I have now run the non-overlapping form on the same pipeline: dev (2020–2023) 48/439 = 10.93%; trailing-60 0/12 = 0.00%; trailing-250 1/50 = 2.00%. The direction survives the correction — trailing-250 is short of the dev rate under both forms (0.29× raw, 0.18× non-overlap) — but the non-overlap cells are tiny (12 and 50 windows, a handful of effective draws), so the honest statement is suggestive, not conclusive, and the trigger thresholds (5.00% / 2.50%) must be restated against the effective-sample distribution before anything is filed. That restatement is the standing October Desk Review item, not a daily-plan action.
Proposed trigger — to TEMPER, not adopted unilaterally, and held provisional pending the restatement. Under the draft charter the persistence rule (5 consecutive sessions) is satisfied — the low-exceedance state has held the whole live run — so this belongs in a Desk Review shape, not a unilateral move. I propose: request a recalibration review when the trailing-250 exceedance rate is below one-third of the dev rate (< 5.00%) and the trailing-60 rate is ≤ 2.50%, sustained for 60 consecutive sessions — with the thresholds provisional until the non-overlapping/block-bootstrap restatement lands. On today's raw measurement both conditions are met. I am not filing it inside a daily plan — the next monthly Desk Review is the correct shape — and I am changing nothing: no gate, no sizing, no posture, no script.
What I'm watching: (1) the run settling at today's close — the only number that matters, gating a possible 10-01 entry — bounded through the roll: base falls to 282.03, a flat close reads only −0.9999%, and a flag needs a +6.03% or −4.01% single-session close; my call: no flag. (2) The ~$277–279 floor — 09-29 closed and printed at fresh 20-session lows (279.21 / 277.41); a decisive break is the only realistic route to a down-flag, and the post-PCE rates reaction is the most plausible source — but the gate needs five sessions, not one gap-down day. (3) Whether VIX's level holds below the charter's own MID (≥18) shift condition — five consecutive sessions in MID would begin the persistence clock, and that is the state my mechanism actually wants; a hot PCE could start it. (4) My own exceedance rate — the sixth straight short reading, and the first measured in both raw and non-overlapping forms; the restatement is the only thing in this stack's live history that can falsify a silent gate. (5) The event calendar, genuinely live — any flag this week holds across NFP (10-02) and FOMC Minutes (10-07), and I have named that exposure in advance rather than after the fact.
slack: p_trade 0.0, direction none, conviction high)no_trade:no_signal (blocked=run_magnitude; gating run −2.7854% vs ±4.970946% = 2.19pp short; flat book, no 5-day cycle in flight — not an open/hold/close day; next entry window = Thu 10-01's open only if today's close crosses ±4.97%, which would exit the close of 10-08)## Regime Charter (Status: DRAFT — not ratified; the "ratified" mislabel is corrected here).
