data-infra/regime/current.json — status: ok, as_of: 2026-09-22, i.e. stale by six sessions (it lags 09-23, 09-24, 09-25, 09-28, 09-29 and today). Snapshot: spy_day flat, spy_open_to_close_pct −0.08% / spy_vs_sma50 above 50d / spy_drawdown_bucket <2% (spy_drawdown_pct −0.58%) / vix_regime LOW (<18), vix 14.21.^VIX is 16.08 (prior close 16.04) — LOW, ~1.9 points below the LOW/MID boundary at 18. I am not treating 14.21 as current.spy_vs_sma50 above 50d; spy_drawdown_bucket <2%; vix_regime LOW. The one live drift to name: SPY is below its 20-day mean today (764.38 vs SMA20 765.02), whereas the stale file's spy_vs_sma50 read is above — the spy_vs_sma50 tag is the one to watch, and QQQ remains well above (737.96 vs SMA20 722.95).## Regime Charter: the charter is DRAFT — not ratified, and I am held to it as drafted. The draft's claim is that this desk does not need the market to go up: ECHO trades contra the day's direction, SURGE with it, both intraday and direction-agnostic. Today's read — a news-driven, two-sided tape into a Tier-1 inflation print — feeds neither stack a required rally. The plan is consistent with the draft on substance; it is not scored as charter-compliant (the charter is not ratified).spy_vs_sma50 = below 50d, no drawdown ≥ 2-5%, no vix_regime ≥ MID, and neither stack is near 10 consecutive no-fire sessions (ECHO last fired 09-23 → 4 no-fire sessions; today would be the 5th; SURGE last fired 09-28 → 0). No proposal, no posture change, watch only. Carried: if VIX closes ≥ 18 for 5 consecutive sessions the clause arms — I do not move a gate on regime evidence alone. No plan-endorsed trade — firm-wide NO-GO (Tier-1 PCE), and structurally the wrong tape — but the engine is live, so the forecast is a small non-zero, not a 0.0. p_trade 0.10, direction none, conviction low.
The distinction that sets the number: ECHO's cleared code does not implement a PCE hard skip. is_hard_skip_day() (agents/echo/paper_trade.py:341-348) skips {FOMC, CPI, NFP} only; strategy v7's Firm-Wide Hard Skips table lists FOMC/CPI/NFP, prior VIX ≥ 30, and market holiday — no PCE. On the last PCE session (2026-08-26) the engine evaluated in full and logged no_trade:no_qualifying_instruments with per-instrument gate detail (not hard_event:PCE). So today the plan stands down under the firm-wide rule, but the engine will run its gate stack and can fire if a program clears. That is what the non-zero prices — not a plan/engine bug this time, a genuine firm-rule-vs-stack-rule divergence.
p_trade 0.10 is anchored below every realized rate. From intelligence/plan-calibration.csv: 10 fires / 51 scored sessions ≈ 0.20 all-time; 2 / 10 over the last ten = 0.20; 2 / 9 over the last nine eligible (non-event) sessions ≈ 0.22. I sit below all three because ECHO has never cleared a PCE session — 07-30 blocked (SPY vol_ratio 1.043, XLE 0.836, XBI morning_signal) and 08-26 blocked (SPY morning_signal, XLE 0.761, XBI 1.010) — and the chronic binder on a contained / news-driven LOW-VIX tape is vol_ratio, with the morning-signal floor the likeliest early block. I am not lifting on quarter-end participation: the desk's "shock day lifts participation" hypothesis is 0-for-2 (09-24, 09-28) and is not re-run.
direction none — the standing direction-refusal discipline. The briefing explicitly refuses a pre-release directional call ("do not treat the pre-release tape as directional confirmation"), and my entry is contra the observed morning signal anyway; a pre-committed sign on a two-sided PCE tape would be a guess. Direction hit-rate is skipped for a none field.
Sizing vs. event risk: event risk HIGH, but the 15:58 ET hard flat means nothing survives a headline or the session, and the event resolves at 8:30, hours before entry. No event-driven size reduction — and not invoked: standard sizing (0.75% per instrument, 2.0% session budget ($500), stop 1.5× ATR(14, 5-min), flat 15:58) applies only if the engine clears.
Key levels (context, not triggers): SPY 764.38 / range 762.35–766.85 / SMA20 765.02 (below) / ATR14 6.97; QQQ 737.96 / 735.39–740.37 / SMA20 722.95 / ATR14 9.87 (QQQ is not my baseline universe — sector/rates context only). XLE — driver is crude, EIA 10:30 AM is the live sector catalyst; an up-morning energy leg would be a short fade. XBI — no confirmed catalyst, not a candidate (BMS Camzyos PDUFA pending is a single-name event, not an XBI-wide program; the conditional-candidate rule stands: confirm the decision released before any signal check, else drop it).
Invalidation: stand down entirely if (1) every candidate is sub-±0.25% in the first half hour — the modal two-sided-tape case; (2) vol_ratio < 1.2, ADX < 20, or exhaustion_score < 0.80 at 15:20 — the standard wide block; (3) crude reverses and energy becomes the weak leg — XLE flips fade direction, re-evaluate; (4) XBI first-half-hour ≤ −5% (hard skip, live even though XBI is not a candidate). Most likely logged reason: morning_signal or vol_ratio. No overnight exposure — 15:58 ET flat — the PCE print and Friday's NFP cannot be traded today, only gapped through.
Post-release structural question I am watching (the specific one, not filler): after the 8:30 print, does a Tier-1 macro release manufacture the participation ECHO's mechanism requires? Concretely — does any baseline instrument form a one-way program that holds to 15:20 with vol_ratio ≥ 1.2 (and exhaustion_score ≥ 0.80), or does the tape again print a wide morning signal on sub-floor volume? This is the third PCE-day test and directly extends the desk's 0-for-2 "shock day lifts participation" observation (N=2, below the Desk Review's N ≥ 3 bar — a plan-layer observation, not an escalation). Secondary: quarter-end MOC / rebalancing supply — does it create the close-window residual pressure ECHO's thesis relies on, or just add noise?
Pre-entry flags (peer-review commitment, applied as written): every engine fill is logged plan-endorsed / plan-evaluated / plan-declined, wins and losses alike. Still no denominator, so still no enforcement proposal — the plan/engine enforcement gap remains an unvalidated hypothesis and the plan-veto stays out of the gates. No gate logic is touched by anything in this plan.
No trade — deterministic code-level PCE hard skip. p_trade 0.0, direction none, conviction high.
SURGE's cleared code calls is_event_day(trade_date, tier_filter=2) and skips any event day (agents/surge/paper_trade.py), logging no_trade:event: before any signal evaluation. 2026-09-30 is a PCE day, Tier 1 (data/event_calendar/pce_dates.csv), and the skip has fired correctly on both prior PCE sessions (07-30, 08-26). So this is not a session-character judgment like 08-28 — it is the mechanism's own locked event-day skip, and a 0.0 is the honest read of a code-level gate. Sizing not invoked: standard $187.50 / single position / co-fire limiter / hard flat 14:00 ET applies only on a tradeable session.
Even absent the skip, today is a poor fit. A PCE-open session is price-discovery, not a clean trend → measured pullback → resumption three-phase structure; the 07-24 learning has this catalyst-gap class at 0/2, and SURGE's chronic binder is pullback_resumption. VIX 16.08 LOW is its weakest cohort (backtest PF 1.36 in VIX < 20 vs 2.18 at 20–30), and the pre-market is near flat, removing the impulse source that made 09-28's (losing) structure possible.
The tension, stated honestly: SURGE's own event-day skip diagnostic (ratified MIXED 2026-08-01) found event-day trades profitable in both periods and the PCE cohort dev 10t / PF 1.88 — i.e., the blanket PCE skip may be screening out a cohort that pays. That finding produced no live-path change (per-type skip is a TEMPER conversation + a candidate for a targeted future backtest, never a unilateral tweak). The skip stands today.
Invalidation: already fully invalidated by the hard skip — there is no gate-clearing path at all. No overnight exposure — 14:00 ET flat.
Post-release structural question I am watching (the specific one): after the print, does a clean three-phase structure actually form inside 10:00–12:00 — a first-hour establishment that then retraces to session VWAP on contracting volume and resumes (ADX ≥ 22 at the resumption bar)? If it does, it is a foregone observation feeding the MIXED PCE-cohort question (was the skip leaving money on the table?), not a trade. If the tape stays directionless or a trend-qualified leg never retraces, that is the chronic pullback_resumption / first_hour_signal denial, structural absence rather than a threshold graze.
event:PCE); ECHO's cleared code is not — a firm-rule-vs-stack-rule divergence, which is why ECHO carries a small non-zero and SURGE carries a 0.0.p_trade 0.10 / none / low, SURGE p_trade 0.0 / none / high. Not averaged: SURGE's 0.0 is a code-level skip; ECHO's 0.10 sits below its 0.20 all-time and 0.20 recent-ten, on the read that a two-sided PCE tape denies a completed high-participation program and ECHO has never cleared a PCE session.xbi_leg (n=3, WR 0.0%, trigger 15+); ECHO vol_ratio sub-1.0 region (inconclusive); ECHO exhaustion_score live-median watch; SURGE ADX 22.0 floor / re-tune watch; SURGE event-day skip diagnostic (resolved MIXED 2026-08-01); SURGE 2023 PF 0.95 watch; SURGE short-side net negative (8 shorts 4W/4L −$127.35 vs 2 longs 1W/1L +$468.28; sample far below any trigger).Regime watch line above; no persistence trigger armed. current.json is stale by six sessions — I state the bucket from the file and the VIX level (16.08) from the briefing. No trades taken.
