Regime Watch

  • Read: data-infra/regime/current.json — status: ok, as_of: 2026-09-22. Snapshot: spy_day flat, spy_open_to_close_pct −0.08% / spy_vs_sma50 above 50d / spy_drawdown_bucket <2% (spy_drawdown_pct −0.58%) / vix_regime LOW (<18), vix 14.21.
  • Staleness — now three sessions, and it is the whole story of the week. The file lags 09-23 (rates shock), 09-24 (gap-down bought back), and today. Live reads: ^VIX 15.67 at Thursday's close, 15.36 latest (briefing, −0.31). So the bucket is unchanged (LOW), while the level inside it ran 14.21 → 15.18 → 15.67 → 15.36. I take the bucket from the file and the level from the briefing; I am not treating the 14.21 print as current.
  • Charter indicators moving: none of the three shared tags is in a stressed state. spy_vs_sma50 above 50d (SPY 767.29 vs SMA20 765.33, and above the 50d); spy_drawdown_bucket <2%; vix_regime LOW. The one drift is VIX, four sessions higher off the 09-19 low and now ~2.6 points under the LOW/MID boundary at 18. That is a level drift inside the bucket, not a bucket change — and it has reversed direction on the last print.
  • Consistency with the ratified ## Regime Charter: consistent. The charter's claim is that this desk does not need the market to go up: ECHO trades contra the day's direction, SURGE with it, both intraday, both direction-agnostic. Today's read — contained, direction unassigned, with the one genuinely two-way driver being oil lower on a conditional Hormuz headline — feeds both stacks without requiring an SPY rally. Today is, unusually for this month, a session where the driver direction and ECHO's fade direction agree rather than oppose (see ECHO section).
  • Persistence rule: not armed. No spy_vs_sma50 = below 50d, no drawdown ≥ 2-5%, no vix_regime ≥ MID, and neither stack is near 10 consecutive no-fire sessions (both fired 09-23; ECHO last fired 2 sessions ago, SURGE 2 sessions ago). No proposal, no posture change. Item carried: if VIX crosses 18 (MID) and holds for 5 sessions, the charter's persistence clause arms and I file through the Desk Review shapes — I do not move a gate on regime evidence alone.

Shared Market Read

  • Event risk today: MEDIUM. No Tier-1 inside ~2 days — next is PCE Sep 30 (5 days), then NFP Oct 2 (7), FOMC Minutes Oct 7, CPI Oct 14, FOMC decision Oct 28. Firm-wide status GO; every hard skip is CLEAR for both members (no FOMC/CPI/NFP/PCE; prior VIX close 15.67 well under 30; no QQQ mega-cap reporter after the prior close; regular Friday session). Scheduled: 8:30 durable goods (cons. ≈ −0.3%, spread −0.3 to −0.5%, vs +1.1% prior; ex-transport the cleaner read on capex), 8:30 wholesale/retail inventories, 10:00 Michigan final (prelim 47.8 vs Aug 51.7), 1:00 Baker Hughes rig count. Earnings are effectively nil — this is a light earnings Friday; do not condition on a catalyst slate. MEDIUM rests on the live headline clock, not a scheduled binary: Iran's FM Araghchi disclosed a conditional seven-day Hormuz roadmap (reopen at day seven if conditions are met; White House had not responded). That is a two-sided offer running across the weekend, and it is the session's only real driver.
  • Session character expected: contained, mixed, mildly risk-on at the open — and, per the briefing, with both tier polarity and index direction explicitly unassigned. Pre-open futures are modestly higher with the Nasdaq 100 leading (≈ +0.5–0.6% vs +0.2–0.3% S&P/Dow), the bid narrow and catalyst-driven (chips: AMD ≈ +2.1%, INTC +1.7%, AVGO +1.3%, NVDA +0.45%; plus Meta near $2T), and capped by the same two ceilings as every session this week — crude above $100 and the 10-year near 5.2% (eased to ~5.16–5.19% off Thursday's ~5.208% near-20-year high). The week has produced four consecutive contained sessions at or inside ~1.0× ATR (Thursday: SPY and QQQ both 0.85× ATR, a gap-down open fully bought back). Containment is the base case, not expansion — a wide durable-goods consensus spread into a low-impact print is not a range-expansion catalyst.
  • VIX regime: 15.36 — LOW (<18), down 0.31 from Thursday's 15.67. LOW is the weakest cohort for both members: ECHO needs a completed, high-participation program to have something to exhaust, and SURGE's PF is 1.36 in VIX < 20 vs 2.18 at 20–30. Neither stack has a VIX parameter (no VIX skip in SURGE's cleared code; ECHO's skip is a first-half-hour |return| proxy, 1.8%), so this is a forecast input, not a gate.
  • Key levels: SPY prior close 767.29 (prior range 763.25–768.94; SMA20 765.33 — above; ATR14 6.70). QQQ prior close 741.09 (prior range 734.66–742.63; SMA20 719.72 — above; ATR14 9.37). Trailing ATR is normal, so an open beyond roughly ±0.5% (SPY ≈ 3.8 pts, QQQ ≈ 3.7 pts) is a genuine gap rather than noise — and the levels that matter are yesterday's session extremes (SPY 763.25 / 768.94; QQQ 734.66 / 742.63), not new volatility bands. XLE has no authoritative pre-market level in the briefing block; my own last print is the 09-15 fill at 65.785 (agents/echo/performance/trades.csv), context only. The energy driver line is crude's level: Brent ~$105 (off ~1–2%, still above $100), WTI down harder into the high-$90s — a break back above the prior spike re-arms the squeeze; a continuation lower extends the relief.
  • Macro backdrop: two pressures easing at once — a conditional Iranian offer pulling crude off its highs, and the long end pausing a few basis points below a near-20-year high — while ~77.5% is still priced for an October hike (Williams called another hike "reasonable"; FedWatch up from ~53% a day earlier). Relief, not reversal.
  • Desk-level consequence. This is the first session this week where the desk's dominant failure mode is not pointed at by the tape. On 09-23 the strengthening drivers were rates and oil and both members' mechanisms sat on the wrong side of them; on 09-24 the drivers were live again and neither stack printed. Today those two channels are easing, and the one genuinely two-sided leg is energy down on a conditional headline — which puts ECHO's contra rule on the allowed side of the fade (fading a declining driver) and puts SURGE's with-trend rule on a long if the pre-market chip bid confirms. The honest counterweight: the pre-market bid is chip-led and narrow, and a one-way gap-up drift is the shape that has repeatedly denied SURGE its measured pullback and would put an ECHO short on the refused side of the rule.

ECHO — dynamic universe (SPY/XLE/XBI baseline; Scanner watchlist supplements), close-leg exhaustion fade at 15:30 ET

Setup present: possible, and for once on the mechanism-consistent side of my own driver rule. p_trade 0.30, direction long, conviction low.

p_trade 0.30 is anchored, not asserted. Realized base rates from intelligence/plan-calibration.csv: 10 fires / 49 scored sessions = 0.20 all-time; 3 / 10 over the last ten sessions = 0.30; 3 / 7 over the last seven eligible (non-event) sessions = 0.43. 0.30 sits at the recent ten-session realized rate and above the all-time rate. It is not raised for the 09-23 clear (the peer-review lesson: a recent clear is not evidence the gate stays warm) and not raised to 09-24's 0.35, because 09-24 carried a directional gap-down open plus a harder catalyst slate and still produced the modal wide block — vol_ratio 1.166 on SPY, vwap_persistence on XLE and XBI. The modal no-print on this tape is a wide block (vol_ratio/ADX), not a graze, and a contained, mildly-up Friday is the same shape.

direction long is the honest first-trade sign, and it is the coherent one. My entry is contra the morning signal. Grading the Scanner watchlist's Directional Catalyst Instruments against my gate stack (morning signal ≥ ±0.25%, VWAP persistence, ADX(14, 5-min) ≥ 20, vol_ratio ≥ 1.2, exhaustion_score ≥ 0.80):

  • XLE — DOWN bias, CLEAR, intrinsic sector catalyst — and my most likely firer. Oil is lower 1–2% on the Hormuz roadmap; energy was the weakest European sector overnight; the watchlist frames it as a trending-day candidate on the short side, conditional on the headline holding. A down-morning XLE means my contra entry is LONG XLE — i.e. I fade a declining energy driver. That is the allowed side of my own 08-10 rule (the loss template is fading the driver's own strengthening sector — shorting XLE into a rising oil tape, the trade I refused on 09-24). Mechanically this is also the leg closest to clearing: XLE has repeatedly printed vol_ratio at 1.18–1.36 (its last two fired trades printed 1.3637 and 1.3604; its recent blocks were 1.180 / 1.179 / 0.992), and a Hormuz-headline energy session should carry above-average participation — exactly what the 1.2 floor wants. Plan-evaluated and endorsed as my primary path, with the caveat stated below.
  • SPY — UP bias (weakest catalyst rating; the default because no stronger broad-market candidate exists), CLEAR. An up-morning SPY means my contra entry is a SHORT into the tape the chips are bidding — that is the refused class if the open confirms the pre-market chip bid as a one-way program. SPY is also the leg most likely to sit sub-±0.25% and contested (the 09-22 +0.04% block; the 09-09 0.01 miss), and its vol_ratio has been the modal blocker this month (1.166 / 1.179 / 0.792). Plan-evaluated, not endorsed. The briefing's explicit "do not pre-assign tier polarity" applies: if the chip bid fades and the broad tape is the strong leg, this becomes a different trade.
  • QQQ — UP bias (narrow, chip-led), CLEAR on the gates. The Nasdaq complex is the firmer leg pre-market (futures +0.5–0.6%). An up-morning QQQ is a SHORT fade of the AI/chip bid — again the refused class on the same condition as SPY. QQQ is not in my baseline universe and was removed from the dev universe in v4 on mega-cap-concentration grounds; today's catalyst is sector/rates-level, not a constituent print, so the v4 caveat does not arm. Plan-evaluated, not endorsed.
  • AKAM (+21–23%, a $11.6B Anthropic commitment plus a Lenovo SOW and a Jabil build authorization) — plan-declined as a class, not as a calendar item. The watchlist lists it as ECHO-qualified on "intrinsic catalyst"; I refuse it on the mechanism-class finding (TEMPER 2026-07-24, the INTC 7/23–7/24 sequence): a single-stock event gap completes its move in the first ~90 minutes, not across a six-hour program cycle, so there is no exhausted all-day program at 15:20 to fade — and a 20%+ gap makes VWAP persistence degenerate. This is deliberately not the 08-20 error (XBI excluded on a calendar basis while the mechanism traded it): the exclusion here is instrument-class and mechanism-anchored. Plan-declined; the engine may still take it and I cannot enforce a veto.
  • XBI — plan-declined for lack of an intrinsic catalyst, but plan-evaluated as a baseline instrument. No FDA decision is scheduled for 09-25 (September PDUFAs were Sep 19 / Sep 22 / Sep 27, and the Sep 19/22 items are already approved), so it is not a watchlist candidate. I am recording it as declined-on-catalyst, evaluated-on-mechanism, because the 2026-08-20 TEMPER finding is exactly that ECHO's calendar-anchored XBI exclusion was wrong while the engine traded it anyway. xbi_leg sub-book is n=3, WR 0.0%, PF 0.0 (08-19, 08-20, 09-23); the exclusion review triggers at 15+ live trades — not triggered, carried untouched.
  • XLE/SPY driver caveat, stated rather than buried. A long XLE fade of a declining energy sector is the allowed class — but the decline is fuelled by a conditional offer, so the driver can invert on one headline, and a Hormuz reopening is a persistent supply repricing rather than an exhausted program. If crude reverses back above the prior spike intraday, the same long XLE trade becomes a fade of a strengthening driver — the refused class. My mechanism has no code for that distinction; the plan does, and the plan is prose.

Sizing vs. event risk: event risk MEDIUM with no event tail — the 15:58 ET hard flat means nothing survives a Hormuz headline, the 10:00 Michigan final, or the weekend. No event-driven size reduction. Mechanically standard: 0.75% dollar risk per instrument, 2.0% session budget ($500), proportional scaling if combined risk exceeds budget, stop 1.5× ATR(14, 5-min), hard flat 15:58 ET. With XLE the endorsed path and SPY/QQQ evaluated-but-not-endorsed, this is most plausibly a one-position session, occasionally two (09-21 printed SPY short and XLE long on the same session).

Pre-entry flags (peer-review commitment, applied as written): every engine fill is logged as plan-endorsed (XLE), plan-evaluated (SPY, QQQ, XBI), or plan-declined (AKAM, and any single-stock event gap), wins and losses alike. There is still no denominator and therefore still no enforcement proposal — the plan/engine enforcement gap remains an unvalidated hypothesis and the plan-veto stays out of the gates. No gate logic is touched by anything in this plan.

Key levels (context, not triggers): SPY 767.29 prior close / range 763.25–768.94 / SMA20 765.33 / ATR 6.70 — an up morning ≥ 0.25% is the fade I evaluate and do not endorse; a down morning is absent from the endorsed path today. QQQ 741.09 / 734.66–742.63 / SMA20 719.72 / ATR 9.37. XLE — last own print 65.785 (09-15 fill); the driver line is crude: Brent ~$105, WTI high-$90s; above the prior spike re-arms the squeeze, a further slide extends the relief. 10-year ~5.16–5.19% (off ~5.208%); ~77.5% priced for an October hike.

Invalidation: stand down entirely if (1) every candidate is sub-±0.25% in the first half hour or direction flips ≥2 times — the contained day's modal chop; (2) vol_ratio sub-1.2, ADX < 20, or exhaustion_score < 0.80 at 15:20 — the standard wide block, and the likeliest single branch on a contained LOW-VIX tape; (3) crude reverses back above the prior spike (the long XLE fade becomes the refused class — I would decline it in prose; the engine would not); (4) the open confirms a one-way up program and the only clearing legs are SPY/QQQ — a short fade of the chip bid, evaluated and not endorsed; (5) any single-stock event gap (an AKAM-class name) presents as a fade — declined as a class. Most likely logged reason: vol_ratio (the modal blocker three of the last four sessions) or morning_signal. No overnight exposure — 15:58 ET flat — so the Iran clock cannot be traded today, only gapped through on Monday.

SURGE — SPY/QQQ, VWAP pullback resumption (10:00–12:00 ET)

Setup present: possible but marginal — a mildly directional, chip-led open that is also exactly the one-way shape that denies a retrace. p_trade 0.15, direction long, conviction low.

SURGE is live (no FOMC/CPI/NFP/PCE; no QQQ mega-cap earnings day; no VIX skip exists in the cleared code so VIX 15.36 does not gate it).

p_trade 0.15 is anchored, not asserted. Realized base rates from intelligence/plan-calibration.csv: 6 fires / 49 scored sessions = 0.12 all-time; 1 / 10 over the last ten = 0.10; 2 / 15 over the last fifteen eligible sessions = 0.13. 0.15 is a modest lift above that, for two specific and non-recency reasons: (a) the pre-market is mildly directional and Nasdaq-led, and my precondition begins with an establishment — a one-directional open is where establishments come from; and (b) there is a front-of-window 8:30 print (durable goods) plus a 10:00 Michigan final, the same structural class that manufactured the clean establishment → 42.1% retrace → 11:45 resumption on 09-23. It is below 09-24's 0.20 because that day paired a harder front-of-window catalyst (claims, plus a gap-down tech-led open giving QQQ a genuinely directional tilt) with a leg that still never produced a pullback — Thursday blocked at first_hour_signal on SPY (−0.22%) and vwap_side on QQQ. It is not raised for the 09-23 win (N=1; the peer-review rule against recency-weighted fire rates applies here as much as to ECHO).

Why not higher — the shape risk is concrete and chronic. A gap-up, chip-led open is the one-way drift that has repeatedly denied my measured pullback: on 09-21 both legs trend-qualified (SPY ADX 54.9, QQQ 71.0) and neither produced a VWAP-touch resumption; 09-10 and 09-22 blocked at pullback_resumption with trend-qualified legs; 09-18 SPY grazed adx at 21.1 vs the 22.0 floor. Thursday's own tape (gap down, low printed in the first quarter-hour, +0.81% grind off the open, flat last hour, 0.85× ATR) is the kind of session that produces an establishment with no retrace. The durable-goods print carries a wide −0.3 to −0.5 consensus spread against a +1.1% prior, so its surprise potential is two-sided rather than directional, and Michigan's final is a second read of an already-known weak 47.8 — low surprise potential. Neither is the decisive mechanical print that 09-23's flash PMI was.

Direction: long — a plan-layer sign only. My mechanism resolves direction from the observed first-hour impulse at evaluation time, not from a pre-committed sign (on 09-23 it scored a direction miss on a winning short; TEMPER has the field flagged as a scoring artifact for this stack). I sign long because the observable today is a mildly higher, Nasdaq-led pre-market with QQQ the firmer leg, so a with-trend resumption would be long QQQ or SPY — and it is the side where my P&L lives (live long +$468 vs short +$15, though n=8 total). If the tape opens down, the mechanism takes the other side and this sign is simply wrong, as designed.

Sizing vs. event risk: event risk MEDIUM, but I never carry it — the 14:00 ET hard flat leaves no exposure into the afternoon of a weekend-spanning Iran clock. Standard sizing applies only if a full three-phase structure completes: 0.75% ($187.50), single position, co-fire limiter (stronger |signal_return| between SPY/QQQ wins). No adjustment, and I am explicitly not sizing for a trade I merely tilt toward. No VIX skip is added; the session-character read is a forecast, not a parameter.

Key levels (context, not triggers): SPY 767.29 prior close / range 763.25–768.94 / SMA20 765.33 / ATR 6.70; QQQ 741.09 / 734.66–742.63 / SMA20 719.72 / ATR 9.37 — QQQ is the firmer leg, so a completed up-structure calls long QQQ or SPY. The operative level is each leg's session VWAP through the window, and today it is a clean reference (no rebalance, no witching): a bar-over-bar pullback that touches VWAP on contracting volume and then a resumption close back beyond it in the trend direction, with ADX still ≥ 22 at the resumption bar. Note the 22.0 ADX floor is a live graze candidate (09-18: 21.1) and the moderate 22–30 band is where the 09-23 winner (26.05) landed — the ADX re-tune watch, not a change.

Invalidation (the expected outcome, not a contingency): (1) the 8:30 durable-goods print reverses the pre-market tilt and the first hour is directionless chop — the contained day's modal case; (2) a leg trend-qualifies but no VWAP-touch pullback resumes inside 10:00–12:00 — the chronic pullback_resumption block, and the single most likely logged reason (09-10, 09-21, 09-22); (3) the gap-up drive extends one-way without retracing — the same failure mode, on this tape's most likely shape; (4) neither leg reaches a ±0.30% first-hour impulse. Most likely reason: no_signal at first_hour_signal or pullback_resumption — structural absence, not a threshold graze, and neither re-opens the first-hour-floor question (closed by the 09-05 deliverable; the 09-18 SPY 21.1 ADX graze is a different gate). No overnight exposure — 14:00 ET flat.

Plan Filed

  • Filed: 2026-09-25 04:45 PDT
  • Frontmatter forecasts complete for every active member: yes
  • Firm-wide status: GO (event risk MEDIUM, VIX 15.36 LOW, regular Friday session). No hard skip fires for either member — both live on paper.
  • Desk net forecast: ECHO p_trade 0.30 / long / low, SURGE p_trade 0.15 / long / low. The two are not symmetric and not averaged: ECHO's 0.30 is its own recent ten-session realized rate (all-time 0.20; 10/49); SURGE's 0.15 is ~1.2× its own all-time rate (6/49) with a modest lift for a directional open offset by the one-way-drift risk. Both directions are plan-layer signs; ECHO's is contra the expected XLE down-morning (a long fade of a declining driver — the allowed side of the rule) and SURGE's is with-trend long on the firmer QQQ leg.
  • Carry: neither stack carries overnight risk — ECHO flat 15:58 ET, SURGE flat 14:00 ET — so the Iran seven-day clock that runs across the weekend cannot be traded today, only gapped through on Monday; a quiet Friday is not confirmation of a quiet weekend. Next Tier-1 PCE Sep 30.
  • Carried TEMPER items (unchanged, untouched — no gate logic modified this session): ECHO plan/engine enforcement gap (unvalidated hypothesis, pre-entry flags now logged each session, no denominator yet, no enforcement proposal); ECHO xbi_leg (n=3, WR 0.0%, trigger 15+); ECHO vol_ratio ≥1.5-tier-discrimination watch (N=1, from 09-23); ECHO exhaustion_score live-median watch; SURGE session-character / catalyst-gap filter conversation (carried with the 09-23 N=1 counter-instance); SURGE ADX 22.0 floor / re-tune watch (moderate-band win 09-23; 21.1 graze 09-18); SURGE event-day skip diagnostic (resolved MIXED 2026-08-01); SURGE 2023 PF 0.95 watch.
  • Regime: charter-consistent; Regime watch line above; no persistence trigger armed. current.json is stale by three sessions — I state the bucket from the file and the VIX level from the briefing rather than treating 14.21 as current.

House Echo Desk Reflection — 2026-09-25 (Friday)

Cadence rule header: Weekly/Friday or same-day-on-trade (WS5). Today is the weekly Friday floor trigger — neither member traded, so the Friday cadence is what brings this session under review. Period covered: 2026-09-24 through 2026-09-25 — the two sessions since the 09-23 reflection. Neither member traded on either session: desk trade_count 0, desk net P&L $0.00. This is the desk's first consecutive desk-wide no-print pair since 09-17/09-18 (trades.csv).

Plan reference: desks/house-echo/plans/2026-09-25-plan.md (and 2026-09-24-plan.md) EOD briefing: dadbrain/Analysis/briefings/2026-09-25-eod.md

What Happened

Two quiet sessions, two different quiet reasons, and for once the desk's problem is not that its plans disagreed with its engines — it is that neither the tape nor the participation was there at all. On 09-24 the tape gapped down and was bought back (SPY and QQQ both 0.85× ATR, flat last hour); on 09-25 it drifted up in an orderly, Dow-led advance — SPY close 771.35, +0.53% vs prior close (+0.34% open-to-close), true range 5.94 vs ATR 6.83 (0.87×); QQQ close 744.44, +0.24% vs open, true range 6.17 vs ATR 9.44 (0.65×); last hour +0.10% SPY / +0.03% QQQ; VIX 14.87, LOW. The week's single variable, crude, eased hard — Brent −2.8% to $97.44 on the still-unaccepted Iranian seven-day Hormuz proposal — and energy was the weakest sector overnight and through the session, with the Dow (+0.9%) leading a broad advance. That is the environment the desk's charter names as its working condition (orderly, directional, no need for SPY to rally), and it produced zero prints, which is the honest headline of this period.

  • ECHO — 2 sessions, 0 trades. 09-24: SPY blocked vol_ratio 1.166 vs 1.2 (a 0.034 miss) with signal −0.32% (morning signal cleared); XLE blocked vwap_persistence (price 62.75 vs VWAP 62.89, long); XBI blocked vwap_persistence (price 155.88 vs VWAP 154.64, short — price 0.8% on the wrong side, not a graze). 09-25: all three baseline instruments cleared the morning signal and blocked on vol_ratio, all wide — SPY 0.998, XLE 0.980, XBI 0.787 vs the 1.2 floor, on signals of +0.33% / −0.89% / −0.59%. The 09-25 plan had endorsed the long-XLE fade (a down-morning energy sector is the allowed side of my 08-10 driver rule, and on 09-25 the driver direction and the fade direction finally agreed). It blocked on a 0.22-wide participation miss, on a session whose realized range itself says no program ran.
  • SURGE — 2 sessions, 0 trades. 09-24: SPY blocked first_hour_signal −0.22% vs ±0.30%; QQQ blocked vwap_side (short, close 737.27 above VWAP 736.13). 09-25: both legs sub-floor on first_hour_signal — SPY +0.04%, QQQ +0.28% vs the ±0.30% floor, the QQQ read a 0.02 miss. There was no index impulse to establish a trend in the first hour, so the three-phase precondition never got its first phase. Runner note: my 1:30 PM run hit the 60s per-agent watchdog and wrote no artifact (intelligence/runner-health-2026-09-25.md lists SURGE as failed_or_timeout), which is why the EOD briefing reports SURGE as "unconfirmed". The orchestrator backfilled it (python agents/surge/paper_trade.py 2026-09-25): SPY no signal, QQQ no signal, no qualifying instrument, no trade. SURGE's true 2026-09-25 state is a confirmed quiet no-signal day, not a failure — the missing artifact was an operational hole, not a market-reading one, and the EOD's "unconfirmed" flag is corrected by the backfill.

Self-critique — the forecast layer was honest and well-calibrated this period, and it did not matter, which is itself the finding. All four scored rows landed in the correct direction and the Brier scores are the best the desk has posted on a no-trade window: ECHO 0.35 → no trade → 0.1225 (09-24) and 0.30 → no trade → 0.09 (09-25); SURGE 0.20 → no trade → 0.04 (09-24) and 0.15 → no trade → 0.0225 (09-25). I anchored ECHO's 0.30 to its own recent ten-session realized fire rate rather than lifting it after the 09-23 clear, and anchored SURGE's 0.15 ~1.2× above its all-time 6/49 — the peer-review rule against recency-weighting, applied. Both stacks called the containment right (both plans wrote containment as the base case, and both sessions closed at or inside ~1.0× ATR) and both called the driver right (oil lower on the Iran headline; ECHO's 09-25 plan named the long-XLE fade as its primary path and the driver did decline). What I did not anticipate is that the binding constraint would simply be the absence of participation itself — vol_ratio below 1.0 on all three instruments, on a session with normal trailing ATR and a 0.87× realized range. That is not a threshold I can write a better plan around; it is the definition of a session with no program in it. The one thing I want to be honest about rather than self-serving: the blocked endorsed path (long XLE) was not obviously a missed win — energy was the session's weakest sector and stayed weak into the close, so fading a declining energy driver long had the driver still running against it. I make no counterfactual claim beyond the block itself.

Peer review — both 09-23 critiques against this desk were dispositioned "acted", and this period is where I executed the corrections. House Delta and House Mneme independently attacked the plan/engine enforcement-gap cluster (my 09-23 "N=5, 0W/5L") on the same ground: membership defined after the outcome, no denominator, no comparison class. I checked the 2026-09 Desk Review and found my own 09-23 line was factually wrong — that review's sizing_b_count is 0 and its Pattern #4 was sized regime-no-escalation; it never sized the gap as gate-level enforcement. What I have done with it, in writing, in the 09-24 and 09-25 plans: the record is corrected; the gap is reclassified from "calibration" to an unvalidated hypothesis; the learnings flag inviting a gate-level enforcement conversation is withdrawn until a reference class exists; the plan-veto stays out of the gates; and from 09-24 every engine fill is pre-flagged plan-endorsed / plan-evaluated / plan-declined, wins and losses alike, to build that reference class. This period contains no new fill, so the reference class gained zero rows and the hypothesis remains exactly where the critiques left it. XBI stays a signal-quality question under the xbi_leg sub-book (n=3, WR 0.0%, review triggers at 15+ — not triggered).

Per-Member Binding Gate Analysis

ECHO — binding gate: vol_ratio, and the near-miss data says REGIME (wide misses, one double-blocked graze, already-covered floor range)

vol_ratio was the binding gate on 4 of the 6 instrument-sessions this period, and the shape of those misses is the whole argument:

  • 09-25 — wide, on all three, on the quietest participation of the week. 0.998 / 0.980 / 0.787 against a 1.2 floor. XBI's 0.787 is 0.41 under — there is no reading of that as a graze. On a session with normal trailing ATR and a 0.87× realized SPY range, sub-1.0 vol_ratio is the signature of no program having run, which is exactly what the strategy needs to exist before it can be exhausted.
  • 09-24 — one narrow miss, and it is double-blocked. SPY's 1.166 vs 1.2 (0.034) looks like a graze, but on the strategy's own composite (vol_ratio × |signal_return|) that day's exhaustion_score would have been ≈0.37 against the 0.80 floor — more than double under. This is the same double-block structure the 2026-09-05 vol_ratio deliverable found on the flagged XLE grazes: loosening vol_ratio alone converts nothing because exhaustion_score binds independently.
  • The floor range this period asks about is already tested. Loosening to 1.0 would have pulled 09-25's SPY/XLE into range, and the 09-05 diagnostic tested exactly floor=1.00 across every logged trading day since 2026-06-22: 2 new trades, 50% WR, PF 0.128 — worse than the strategy's own benchmarks, not better. No new evidence for a floor conversation; nothing here is unanswered by the existing deliverable.
  • The one genuinely open item is untouched. The 09-18 learnings flag left an N=2 XBI-specific question (09-17 vol_ratio 1.120, 09-18 1.187 — both with exhaustion_score that would clear, so the XLE-concentrated 09-05 verdict does not fully cover them). This period adds no new XBI vol_ratio instance (09-25's XBI blocked at 0.787 — a wide, different-shaped miss; 09-24's XBI blocked on vwap_persistence). XBI stays N=2, not escalated. Note also that 09-25's XLE would have scored exhaustion_score ≈0.87 on the stated formula — but its vol_ratio was 0.980, well below the 1.05–1.10 range the deliverable tested, so it lands in the already-tested floor=1.00 cell, not in a new one.

Regime or calibration? REGIME. No threshold was repeatedly grazed this period in the desk-calibration sense: one narrow miss (double-blocked downstream), one wrong-side VWAP read, and a set of wide participation misses on a session that visibly carried no program. Nothing to tune, and no tuning would have been sanctioned even had it looked closer — the 09-05 deliverable is the evidence, and T=0.80 / the 1.2 floor are not mine to move.

SURGE — binding gate: first_hour_signal, and the near-miss data says REGIME … with a floor graze that the already-run 09-05 diagnostic covers

SURGE's precondition starts with an establishment, and this period the tape never produced one:

  • 09-25 — SPY +0.04%, QQQ +0.28%. SPY effectively printed no first-hour impulse at all; QQQ's 0.02 miss against ±0.30% is a real near-miss, and it is the second graze of this class in the recent record (09-03: QQQ +0.27%, a 0.03 miss; 09-18: SPY adx 21.1 vs 22.0 — a different gate). The session's own character explains it: a contained, orderly, Dow-led +0.34% drift with QQQ at 0.65× ATR and a +0.03% last hour. A one-way drift into the bell is the shape that denies both an impulse and the measured pullback that follows one.
  • 09-24 — SPY −0.22%, and QQQ on the wrong side of VWAP for the rule's direction (short while price sat above VWAP). The gap-down-open-bought-back session produced no sustained establishment either.
  • The floor question was closed by evidence on 2026-09-05, and this period confirms its shape. deliverable_first_hour_floor_2026-09-05 toggled SIGNAL_THRESHOLD across 0.0030/0.0025/0.0020/ 0.0015 on every logged day: at floor 0.0025 — the range that would address QQQ's 0.28% graze — zero new trades unlock, because the downstream pullback/resumption price-path requirement (ADX ≥ 22, correct VWAP side, a VWAP-touch pullback that resumes inside the window) independently blocks those days. Today's 0.02 graze sits in exactly that already-tested cell. The honest caveat: the near-miss log records only the first blocking gate, so I cannot claim QQQ's 0.28% day would have gone on to qualify and then been blocked at pullback_resumption — that is what the 09-05 diagnostic already measured across the same floor range, and reproducing it 20 days later is not new evidence.
  • The occasional tension worth naming once: the 09-18 learnings entry called the first-hour floor the "mechanism-gate-confirmed" binding constraint after 09-10's SPY read (−0.66%) cleared the floor and then died at pullback_resumption (≥11 trend-qualified no-shows since 07-15). Both readings are true and they are not in conflict: the floor blocks on impulse-absent sessions, and the resumption gate blocks on impulse-present-but-structureless ones. QQQ 0.28% today is the first class; 09-21's ADX 54.9/71.0 double-qualification was the second.

Regime or calibration? REGIME. The index-level impulse was structurally absent — SPY printed +0.04% in the first hour. The single 0.02 graze is the one piece of calibration-shaped evidence, and it is the piece with a completed diagnostic already attached to it. No gate touched.

Narrative finding: the desk has spent six weeks explaining no-prints as gates blocking mechanism-faithful setups, and twice as plans disagreeing with engines. This period is the first window where neither story applies: the setups were structurally absent, and the desk's own forecast layer correctly and cheaply predicted the absence (four rows, Brier 0.0225–0.1225, no trades). The regression to watch is not a threshold — it is that a LOW-VIX, contained, sub-1.0 vol_ratio tape can deny both mechanisms at once while the session still looks "directional" in the briefing's character line. Consistency with the regime charter is intact; nothing here is evidence for changing posture.

Regime Watch

data-infra/regime/current.json — status: ok, as_of: 2026-09-22, i.e. stale by three sessions (it lags the 09-23 rates shock, 09-24 and 09-25). Snapshot: spy_day flat, spy_open_to_close_pct −0.08%, spy_vs_sma50 above 50d, spy_drawdown_bucket <2% (spy_drawdown_pct −0.58%), vix_regime LOW (<18), vix 14.21. The live VIX path over the period — 15.18 (09-23 close) → 15.67 (09-24) → 14.87 (09-25 close, briefing) — stays inside the LOW bucket throughout; the file's 14.21 print is not treated as current, only its bucket is. None of the three shared tags is in a stressed state (spy_vs_sma50 above 50d — SPY 771.35 above SMA20 765.34; spy_drawdown_bucket <2%; vix_regime LOW), so against the desk's ## Regime Charter — which is still DRAFT, not ratified, and which I am held to as drafted — this period is charter-consistent: the desk does not need the market to go up (ECHO fades the day's direction, SURGE rides it, both intraday and direction-agnostic), and the two sessions traded consistently with that with no posture change. Persistence rule: not armed. No 5-session stretch in a stressed tag state, and neither stack is anywhere near 10 consecutive no-fire sessions (both fired 09-23; each is now at 2 no-fire sessions). If VIX closes ≥18 for 5 consecutive sessions the clause arms and I file through the Desk Review shapes — I do not move a gate on regime evidence alone. No proposal, no posture change, watch only.

Open TEMPER Items (Carried Forward)

  • ECHO — plan/engine enforcement gap: reclassified to an UNVALIDATED HYPOTHESIS (peer-review actioned, 09-24). The "N=5, 0W/5L" cluster is no longer cited as calibration evidence; the 09-23 reflection's claim that the 2026-09 Desk Review "sized it sizing-(b)" is corrected as wrong (sizing_b_count = 0; Pattern #4 was sized regime-no-escalation). The pre-entry flag taxonomy (plan-endorsed / plan-evaluated / plan-declined) is live from 09-24; this period has no fills, so the reference class gained 0 rows. No enforcement proposal; plan-veto stays out of the gates. Nothing here is a gate change and nothing here is proposed.
  • ECHO — xbi_leg sub-book: n=3, WR 0.0%, PF 0.0. Exclusion review triggers at 15+ live trades — not triggered. This period added no XBI instance of the open 09-18 XBI-specific vol_ratio question (N=2: 09-17 1.120, 09-18 1.187 with exhaustion clearing), which remains the one floor-adjacent item not fully covered by the XLE-concentrated 09-05 deliverable.
  • ECHO — vol_ratio ≥1.5-tier discrimination watch (N=1). Unchanged — no fill this period. The 09-25 read (XLE 0.980 with exhaustion_score ≈0.87 on the stated formula) lands in the already-tested floor=1.00 cell, not in a new one.
  • ECHO — exhaustion_score live-median watch. Unchanged; still far from the 40-trade validation point.
  • SURGE — first-hour-signal floor question: CLOSED (09-05 deliverable), and it absorbed this period's graze. QQQ +0.28% vs ±0.30% is a 0.02 miss inside the already-tested range (zero new trades at floor 0.0025). No re-opening.
  • SURGE — ADX 22.0 floor / ADX re-tune watch. No qualification attempt this period (both legs sub-floor on impulse), so no new data either way.
  • SURGE — session-character / catalyst-gap filter conversation. Carried unchanged, with the 09-23 N=1 counter-instance attached; 09-25 adds a quiet-session data point on the other side of the same axis (no decisive print, no establishment) but at N=1 and on a floor-blocked day it counts for nothing.
  • SURGE — event-day skip diagnostic (resolved MIXED 2026-08-01) and 2023 PF 0.95 watch: carried, no new data.
  • Operational note (not a gate item): SURGE's 09-25 run tripped the 60s per-agent watchdog and produced no performance/daily_2026-09-25.md; the orchestrator backfilled (python agents/surge/paper_trade.py 2026-09-25 → no signal, no trade) and the state is now confirmed. This is the recurring runner-health class (the 08-18 300s-budget starve and the 09-10 DELTA 60s-watchdog entry in learnings.md) — the second consecutive session the EOD health check has carried REVIEW-level missing artifacts. Flagged for learnings.md desk-scoped in SURGE's reflection; no strategy implication.
  • Plan-scoring note (desk-level, for score_plans.py): unchanged from 09-23 — SURGE's direction frontmatter is not an input to its signal (direction resolves at evaluation time), so the direction-hit field remains a scoring artifact for that stack. Still proposed for TEMPER's consideration, never applied unilaterally.

Learnings Flags (desk-scoped)

Flag for learnings.md: house-echo / ECHO — the binding gate over 2026-09-24 → 09-25 was vol_ratio (4 of 6 instrument-sessions) and the misses were WIDE, not grazes: on 09-25 all three baseline instruments cleared the morning signal (+0.33% / −0.89% / −0.59%) and blocked at vol_ratio 0.998 / 0.980 / 0.787 vs the 1.2 floor. The plan-endorsed path that day (long XLE, the allowed side of the 08-10 driver rule — fading a declining energy sector on a Brent −2.8% session) was blocked by a 0.22 miss. The period's only narrow miss (09-24 SPY vol_ratio 1.166, a 0.034 miss with the morning signal cleared) is double-blocked: on the strategy's own composite that day's exhaustion_score would have been ≈0.37 against the 0.80 floor. Loosening to floor 1.00 — which would have pulled 09-25's SPY/XLE into range — is already tested by the 2026-09-05 vol_ratio deliverable (2 new trades, 50% WR, PF 0.128). Reading: regime, no floor conversation. The 09-18 XBI-specific vol_ratio question stays N=2 (no new instance this period) and is the only floor-adjacent item the XLE-concentrated deliverable does not fully cover. No gate touched.

Flag for learnings.md: house-echo / SURGE — the first-hour impulse was structurally absent across 2026-09-24 → 09-25: SPY −0.22% and +0.04%, QQQ on the wrong side of VWAP (09-24) and +0.28% vs the ±0.30% floor (09-25). The 0.02 QQQ miss sits inside the floor range the 2026-09-05 first-hour-floor diagnostic already converted (zero new trades unlock at floor 0.0025, because the downstream pullback/resumption price-path requirement blocks those days independently), so it is regime, not a re-opened calibration question. Context worth carrying: 09-25 was a contained, Dow-led +0.34% drift with SPY 0.87× ATR, QQQ 0.65× ATR and a +0.03% last hour — the one-way drift shape that denies both an establishment and the measured pullback. No gate touched. Also logged: SURGE's 09-25 runner hit the 60s per-agent watchdog and wrote no artifact; the orchestrator backfilled (no_signal, both legs sub-floor) so the day is a confirmed quiet no-signal state, not a failure.

Desk Summary for Orchestrator

Weekly-Friday cadence reflection for 2026-09-24 → 2026-09-25 — desk net $0.00, zero fills on both sessions (first consecutive desk-wide no-print pair since 09-17/09-18). ECHO 0 trades — vol_ratio was the binding gate on 4 of 6 instrument-sessions, and 09-25 was all three wide (SPY 0.998 / XLE 0.980 / XBI 0.787 vs 1.2) after every instrument cleared the morning signal; the plan's endorsed path (long XLE, fading a declining oil driver on a Brent −2.8% session) blocked at 0.980. The period's one narrow miss (09-24 SPY 1.166, 0.034) is double-blocked downstream (exhaustion_score ≈0.37 vs 0.80) and floor 1.00 is already tested (PF 0.128). Cumulative −$290.45 (n=13, 46.2%, SPRT CONTINUE, LLR −0.082). Verdict: regime. SURGE 0 trades — first_hour_signal bound both legs on 09-25 (SPY +0.04%, QQQ +0.28% vs ±0.30%, a 0.02 miss inside the already-converted 09-05 floor range) and the impulse was absent on 09-24 too. Cumulative +$513.43 (n=9, 55.6%, SPRT CONTINUE, LLR +1.561, +1.384 from CONSISTENT). 09-25's run tripped the 60s watchdog and wrote no artifact; the orchestrator backfilled it → confirmed quiet no-signal day, not a failure (the EOD's "unconfirmed" flag is corrected). Forecast layer was honest and well-calibrated (Brier 0.0225 / 0.04 / 0.09 / 0.1225). Regime watch: current.json as_of 2026-09-22 — stale by three sessions; no shared tag stressed (above 50d, <2% drawdown, VIX LOW 14.87); charter-consistent, persistence rule not armed, no posture change. Peer-review follow-through executed: enforcement gap reclassified to an unvalidated hypothesis, the wrong "sized sizing-(b)" line corrected (sizing_b_count = 0), learnings flag withdrawn, pre-entry flag taxonomy live since 09-24 (0 new rows this period). No gate touched. Two flags filed for learnings.md.
