Regime Watch

  • Read: data-infra/regime/current.json — status: ok, as_of: 2026-09-22. Snapshot: spy_day flat / spy_vs_sma50 above 50d / spy_drawdown_bucket <2% (drawdown −0.58%) / vix_regime LOW (<18), vix 14.21.
  • Staleness: the file is STALE by two sessions — it lags the 09-23 rates-shock close, which lifted ^VIX from 14.21 → 15.18, and today's briefing prints 16.13. I am treating the snapshot as directionally usable, not current, and taking the live VIX/level read from today's briefing. The vix_regime bucket is unchanged (still LOW <18); what is moving is the level inside the bucket (14.21 → 15.18 → 16.13 across three sessions).
  • Charter indicators moving: none of the three shared tags is in a stressed state — spy_vs_sma50 above 50d, spy_drawdown_bucket <2%, vix_regime LOW. The one thing drifting is VIX, three sessions higher and approaching the LOW/MID boundary at 18.
  • Consistency with the ratified ## Regime Charter: consistent. The charter says the desk should not need the market to go up — ECHO trades contra the day's direction and SURGE trades with it, both intraday, both direction-agnostic. Today's plan leans into a down-biased, tech-led, rate-capped tape on both stacks (ECHO fading a down program long at 15:30; SURGE riding a down establishment short at 10:00–12:00). Nothing here requires SPY to rise.
  • Persistence rule: none of the charter's shift conditions holds — no spy_vs_sma50 = below 50d, no spy_drawdown_bucket ≥ 2-5%, no vix_regime ≥ MID for 5 consecutive sessions, and neither stack is near 10 consecutive no-fire sessions (both fired 09-23). No proposal, no posture change. Watch only. The item to carry: if VIX crosses 18 (MID) and holds 5 sessions, the charter's persistence rule arms.

Shared Market Read

  • Event risk today: MEDIUM. No Tier-1 (next PCE Sep 30, 6 days; NFP Oct 2; CPI Oct 14; FOMC decision Oct 28) and no scheduled vol event. The rating rests on two live, simultaneous channels: (1) the long-dated yields / oil squeeze that did the damage Wednesday (10-yr at its highest since 2007, 5-yr touched 5%, Brent back above $100, WTI low-$90s) — the inflation-transmission channel, still not reversed; and (2) the Trump–Xi bilateral session, outcome pending, HIGH headline risk, two-sided and un-timeable (the base case priced is a signal of extension, not a settlement; the US reciprocal-tariff suspension lapses Nov 10). Scheduled items: 8:30 jobless claims (cons. 201K / prior 196K) plus Q2 International Transactions, 10:00 New Home Sales (prior 607K SAAR), 11:00 KC Fed. Firm-wide status GO; all hard skips CLEAR for both members — no FOMC/CPI/NFP/PCE, prior VIX close 15.18 < 30, no market holiday, no QQQ mega-cap reporter after the prior close. DRI / SNX are pre-open reporters and COST reports after the close (call 5:00 PM ET) — a fresh catalyst for tomorrow's tape, not an intraday candidate (the 15:58/14:00 hard flats mean neither member carries COST).
  • Session character expected: gap-down bias, tech-led, event-capped — contained, two-tier, direction explicitly unassigned. The pre-market is lower across all three majors with the Nasdaq complex underperforming the Dow, AI/memory semis the weak leg for a third session, while energy and real-asset proxies hold. This is not a broad liquidation — it is concentrated in rate-sensitive high-multiple tech. The briefing assigns no index direction: the last four sessions all resolved at or inside ~1.0× ATR, so the base case is containment, not expansion, and today the honest call is "contained, two-tier, direction unknown," with the specific lesson from Wednesday that tech is the weak leg on a rising-rate day (the tier polarity inverted once already this week — do not default tech/AI to leadership). The one genuinely one-way driver today is oil: higher again, a second consecutive up session, the inflation channel behind the yield move.
  • VIX regime: 16.13 — LOW (<18), up from 15.18 (prior close) and 14.21 two sessions ago. LOW is the weakest cohort for both members — ECHO needs a completed high-participation program to have something to exhaust, SURGE's PF is 1.36 in VIX < 20 vs 2.18 at 20–30. It is rising toward the boundary, which is directionally helpful to both (a real macro day is being repriced) but is not itself a signal.
  • Key levels: SPY prior close 767.93 (prior range 766.50–773.00; SMA20 765.26 — above; ATR14 6.92). QQQ prior close 741.17 (prior range 738.25–747.12; SMA20 718.23 — above; ATR14 9.49). Both closed near their prior-day lows. Trailing ATR is normal, so any open beyond roughly ±0.5% on SPY is a genuine gap, not noise — and the levels that matter today are yesterday's session extremes (SPY 766.50 / 773.00; QQQ 738.25 / 747.12), not new volatility bands. XLE has no authoritative level in the briefing block — the desk's last own print is the 09-21 15:30 fill at 62.41 (agents/echo/performance/trades.csv), context only. The XLE driver line is Brent > $100 / WTI low-$90s: a break back below $100 inverts the energy read.
  • Macro backdrop: a rate-capped, two-tier tape — tech pays for a 20-year-high long end and $100+ crude, energy and real-assets hold, and a scheduled US–China headline lands on top of an unchanged rates/oil squeeze.
  • Desk-level consequence — the mirror of yesterday, and the seam is in the same place. Wednesday the desk's P&L was decided by two plan-vs-engine gaps: ECHO's engine took a plan-declined instrument and faded a strengthening macro driver (rates shock) into a −$134.52 stop, while SURGE's mechanism completed on a macro-data-print day the plan had written off, for +$30.45. Today both drivers are live again and both point the same way the desk got wrong: the strengthening drivers are rates (10-yr at 20-year highs) and oil (second up day). For ECHO that means a fade of either is, on the desk's own driver logic, the loss template, not the setup — and the mechanism has no code for that distinction. For SURGE it means the opposite of Wednesday is also possible: the pre-market tilt is down and tech is the weak leg, so a with-trend resumption is a short — the side that has historically carried SURGE's P&L (long +$468 / short +$15 live, though 8 trades).

ECHO — dynamic universe (SPY/XLE/XBI baseline; Scanner watchlist supplements), close-leg exhaustion fade at 15:30 ET

Setup present: likely to clear, but on the wrong side of my own driver rule — and I am saying so rather than pricing it away. p_trade 0.35, direction long, conviction med.

p_trade 0.35 is anchored, not asserted: ECHO has fired 3 times in the last 8 eligible sessions (09-15, 09-21, 09-23 — base rate ≈ 0.375), so 0.35 is at the recent unconditional rate, nudged only by the fact that today carries a live, sustained macro driver rather than the contained chop that has produced the modal no-print. It is not raised for the 09-23 clear (the peer-review lesson: a recent clear is not evidence the gate stays warm; the file p_trade to the base rate). direction long is the honest first-trade sign: the pre-market bias is down and tech-led, so a contra entry fades a down morning into a long — and the instrument most likely to clear is a rate-sensitive leg (XBI did it yesterday at vol_ratio 2.017; SPY/QQQ carry the same rates channel today). Conviction is med, not high, because the direction the mechanism will take is the class the desk refuses.

Grading the Scanner watchlist's Directional Catalyst Instruments against my gate stack (morning signal ≥ ±0.25%, VWAP persistence, ADX(14, 5-min) ≥ 20, vol_ratio ≥ 1.2, exhaustion_score ≥ 0.80) at 10:00 and again at 15:20:

  • XLE — LONG bias, CLEAR (intrinsic sector catalyst), and the one candidate I am actively refusing. Oil is higher again, a second consecutive up session, Brent back above $100, WTI in the low-$90s — an accelerating/strengthening energy driver. So the watchlist's "LONG" bias means my fade is a SHORT, into a strengthening energy tape: that is the 08-10 loss template, the exact class my plan refused on 09-23 and the class that stopped me out ten minutes into 09-23 (XBI, fading a strengthening rates shock). Declined as a candidate today; not pre-committed. This is the mirror of Wednesday, when the long-XLE fade of a weakening oil driver was the correct side. Note the tension I will not hide: XLE is the instrument with the clearest instrument-level, same-session fuel source on the whole watchlist, and my mechanism has no code that distinguishes a strengthening driver from a completed one.
  • SPY — DOWN bias, CLEAR, weakest catalyst rating, my mechanism-consistent candidate. A qualification is a long (fade a down morning). SPY closed near its low (767.93 vs range 766.50–773.00), the pre-market is lower and tech-led, and there is no mechanical calendar distortion lifting vol_ratio (the Sep rebalance is spent). But the divergence risk is concrete: if the tape is two-tier (tech weak, broad/Dow holding), SPY is the leg most likely to be sub-±0.25% and contested — exactly the 09-22 block (val +0.04%) and the 09-09 0.01-miss pattern. Evaluated, not pre-committed.
  • QQQ — DOWN bias, CLEAR (awareness), tech is the weak leg. The Nasdaq complex is underperforming the Dow and AI/memory semis are lower for a third session. QQQ is the leg with the larger expected first-half-hour move, so it is the more likely firer — but a QQQ fade long into a rates-driven tech selloff is again the strengthening-macro-driver class, and QQQ's own megacap-concentration caveat (removed in v4 on constituent-level catalysts) does not arm here because today's catalyst is sector/rates-level, not a constituent print. Evaluated under the same decline rule as XLE if the driver is the rates squeeze; not pre-committed.
  • XBI — no catalyst today. No FDA PDUFA dated 09-24 (next Sep 27, Sep 30), so it does not qualify on the intrinsic-catalyst rule. The xbi_leg sub-book is n=3, WR 0.0%, PF 0.0 (last three: 08-19, 08-20, 09-23 −$134.52), exclusion review trigger at 15+ live trades — not triggered, carried untouched. The 09-23 clear (vol_ratio 2.017, the ≥1.5 tier, on a one-way accelerating liquidation) is logged as an N=1 vol_ratio-tier-discrimination watch, not evidence.
  • DRI (~$24B) / SNX (~$12B) — pre-open earnings, refused as a class. Both are instrument-level earnings catalysts that pass my liquidity screen on paper, but both are the single-stock event-gap pattern: TEMPER's 2026-07-24 finding is that single-stock post-earnings/PR gap-ups reverse within the first ~90 minutes, not across the full 6-hour program cycle (the INTC 7/23–7/24 and VKTX 09-22 refusals). The watchlist's own "UP bias — verify at open" flags are pre-open expectations, not verdicts, and a fade here is the 09-15 loss template with an earnings gap attached. Not candidates.
  • COST — after the close (call 5:00 PM ET). Its reaction lands on tomorrow's tape. Not intraday; no position; no post-close exposure (15:58 hard flat).

The honest desk call, stated plainly. ECHO's mechanism is present today (a live rates/oil channel, a directional pre-market, a gap-down tech-led open) in a way it has rarely been this month — but the direction it would take, on either XLE or the tech/rates legs, is the strengthening-driver loss template. My plan declines those candidates in prose. The engine does not read prose.

Sizing vs. event risk: event risk is MEDIUM with no event tail — the 15:58 ET hard flat means nothing survives the summit headlines, the 10:00 New Homes print, or the 11:00 KC Fed. No event-driven size reduction. Mechanically standard: 0.75% dollar risk per instrument, 2.0% session budget ($500), proportional scaling if the combined risk exceeds budget, stop 1.5× ATR(14, 5-min), hard flat 15:58 ET. With XLE declined and the tech legs the likely firers, this is most plausibly a one-to-two-position session.

Calibration discipline — carried peer-review items, and one correction to the record. (1) Correction: my 09-23 reflection and this desk's prior plan both said the 2026-09 Desk Review "sized the plan/engine enforcement gap sizing-(b)". That is wrong — the review's sizing_b_count is 0 and it explicitly says "no new-mechanism row was filed" for the gap (it sized Pattern #4, the busted direction forecast, regime-no-escalation). I built on a premise I had not verified; the line is withdrawn. (2) The gap is reclassified from "calibration" to an unvalidated hypothesis — a 0W/5L cluster whose membership was defined after the outcomes (08-19 XBI, 08-20 XBI, 09-15 XLE, 09-21 SPY, 09-23 XBI), with no denominator (no count of plan-declined fills that won, no count of matching stand-downs). It is not evidence yet, and I will not cite it as such. (3) Going forward I log a pre-entry flag on every engine fill — plan-endorsed / plan-declined / plan-excluded — computed at plan time, wins and losses alike, and build the retrospective reference class (read-only) before any enforcement proposal. Today's XLE / QQQ / DRI-SNX refusals above are plan-declined flags; SPY and XBI are plan-evaluated with no pre-commitment. No gate logic is touched by anything in this plan.

Key levels (context, not triggers): SPY 767.93 prior close, range 766.50–773.00, SMA20 765.26, ATR 6.92 — a down morning ≥ 0.25% is the fade I want. QQQ 741.17, range 738.25–747.12, SMA20 718.23, ATR 9.49. XLE — no authoritative level; last own print 62.41 (09-21 fill); Brent $100 / WTI low-$90s is the driver line, and an up-morning XLE is the fade I refuse. 10-yr at 20-year highs / 5-yr ~5%.

Invalidation: stand down entirely if (1) every candidate's morning signal is sub-±0.25%, or direction flips ≥2 times in the first half hour — the contained two-tier day's modal chop; (2) vol_ratio sub-1.2 at 15:20, ADX < 20, or exhaustion_score < 0.80 — the standard wide block and today the likeliest branch, since the base case is containment and a contained open rarely inflates vol_ratio; (3) XLE's morning bias is up (the fade would be short into a strengthening oil tape — the 08-10 loss template, declined); (4) crude reverses below $100 Brent or the rates channel reverses intraday (either removes the strengthening-driver premise and is a different trade than the one I marked refused); (5) a DRI/SNX-class single-stock event gap presents as a fade — declined as a class. The most likely logged reason is vol_ratio (modal) or morning_signal / vwap_persistence on a two-tier tape. If the engine fires anyway, the honest expectation is that it fires on the declined class — and that outcome, win or lose, is exactly the reference-class data point item (3) above exists to collect.

SURGE — SPY/QQQ, VWAP pullback resumption (10:00–12:00 ET)

Setup present: possible — a macro-print day with a down tilt, against a summit headline window that can fracture it. p_trade 0.20, direction short, conviction low.

SURGE is live (no FOMC/CPI/NFP/PCE; no QQQ mega-cap earnings day). p_trade 0.20 is above the 0.10–0.15 of the 15-session dry stretch for two specific, non-recent reasons: (a) the pre-market is gap-down and tech-led, giving QQQ a directional first-hour tilt (the setup needs an establishment, and a one-directional open is where establishments come from); and (b) this session has a mechanical 8:30 print (claims) and a 10:00 New Home Sales — the same structural class that manufactured the clean establishment → retrace → resumption on 09-23 (QQQ first-hour −0.60%, 42.1% retrace, 11:45 resumption, ADX 26.05, +$30.45). That 09-23 event is N=1 and I am not treating it as a thesis — it is a counter-instance to the catalyst-gap filter hypothesis I have been carrying on a 0W/2L sample, and 0.20 prices it as a tilt, not a base rate (SURGE's live base rate is ~9 trades / ~58 sessions ≈ 0.15; the recent 9-session rate is 1/9 ≈ 0.11). It stays below a coin flip.

Why not higher: the briefing is explicit that summit headlines govern the middle of the session and that "builds that require a quiet tape should be sized accordingly." My precondition is a quiet tape — a pullback that retraces to VWAP on contracting volume and resumes in the 10:00–12:00 window. A headline that fractures rather than retraces the trend is my documented loss class, and it sits precisely where my window opens (the two-sided, un-timeable risk is the middle of my window, not the front). Wednesday's front-of-window events helped; today's biggest catalyst is mid-window and has pending as its only outcome. That asymmetry is the whole reason conviction is low.

Direction: short. This is a plan-layer sign only — my mechanism resolves direction from the observed first-hour impulse at evaluation time, not from a pre-committed sign (09-23 it scored a direction miss on a winning short). I sign it short because the observable today is a down, tech-led open with QQQ the weak leg, so a with-trend resumption would short QQQ (or SPY). If the tape opens up instead, the mechanism takes the other side and the frontmatter sign is simply wrong — as designed.

Sizing vs. event risk: event risk MEDIUM but I never carry it — the 14:00 ET hard flat means no exposure into the afternoon summit window or the after-close COST print. Standard sizing applies only if a full three-phase structure completes: 0.75% ($187.50), single position, co-fire limiter (stronger |signal_return| between SPY/QQQ wins). No adjustment — and I am explicitly not sizing for a trade I merely tilt toward. There is no VIX skip in my cleared code and I am not adding one; the session-character read is a forecast, not a parameter.

Key levels (context, not triggers): SPY 767.93 prior close, range 766.50–773.00, SMA20 765.26, ATR 6.92; QQQ 741.17, range 738.25–747.12, SMA20 718.23, ATR 9.49 — QQQ is the leading weak leg, so if a down structure completes it calls short on QQQ or SPY. The operative level is each leg's session VWAP through the 10:00–12:00 window, and today it is a clean reference (no rebalance, no witching): a bar-over-bar pullback that touches VWAP on contracting volume and then a resumption close back beyond it in the trend direction, with ADX still ≥ 22 at the resumption bar.

Invalidation (the expected outcome, not a contingency): (1) the 8:30 claims / 10:00 New Home Sales block reverses the pre-market tilt and the first hour is directionless chop — the contained day's modal case; (2) a leg trend-qualifies but no VWAP-touch pullback resumes inside 10:00–12:00 — the chronic pullback_resumption block, and the single most likely logged reason; (3) a first-hour drive fractures on a summit headline rather than retracing on contracting volume — my loss class, mid-window; (4) neither leg reaches a ±0.30% first-hour impulse. The most likely reason is no_signal at first_hour_signal or pullback_resumption — structural absence, not a threshold graze, and neither re-opens the first-hour-floor question (closed by the 09-05 deliverable).

Plan Filed

  • Filed: 2026-09-24 04:40 PDT
  • Frontmatter forecasts complete for every active member: yes
  • Firm-wide status: GO (event risk MEDIUM, VIX 16.13 LOW regime, regular Thursday session). No hard skip fires for either member — both live on paper.
  • Desk net forecast: ECHO p_trade 0.35 / long / med, SURGE p_trade 0.20 / short / low. The two are not symmetric and not averaged: ECHO's is anchored to its own recent base rate (~0.375 over the last 8 eligible sessions) with no raise for the 09-23 clear; SURGE's is ~1.3× its ~0.15 live base rate on a directional pre-market plus a mechanics-favourable print day, held down by the mid-window headline risk.
  • Carry: neither stack carries overnight risk — ECHO flat 15:58 ET, SURGE flat 14:00 ET. No Tier-1 today; next Tier-1 PCE Sep 30. COST's after-close print is tomorrow's catalyst, not today's exposure.
  • Carried TEMPER items (unchanged, untouched — no gate logic modified this session): ECHO plan/engine enforcement gap — corrected to "unvalidated hypothesis", not "calibration / N=5 0W/5L", pending a pre-entry reference-class tally (see Calibration discipline above); ECHO xbi_leg sub-book (n=3, WR 0.0%, review trigger at 15+); ECHO vol_ratio ≥1.5-tier-discrimination watch (N=1); ECHO exhaustion_score live-median watch; SURGE session-character / catalyst-gap filter conversation (carried with the 09-23 N=1 counter-instance attached — do not advance on the old 0W/2L sample); SURGE ADX 22.0 floor / re-tune watch (moderate-trend win on 09-23); SURGE event-day skip diagnostic (resolved MIXED 2026-08-01); SURGE 2023 PF 0.95 watch.
  • Regime: charter-consistent; Regime watch line above; no persistence trigger armed.
